10th Amendment Resolution Introduced in Wisconsin

On April 9, 2009, Wisconsin State Senators Leibham, Lazich, Darling, Grothman, Harsdorf and Schultz introduced Senate Resolution 6 (SR6) to claim “sovereignty under the Tenth Amendment to the Constitution of the United States over all powers not otherwise enumerated and granted to the federal government by the U.S.Constitution”

Read the full text of the resolution below:

Whereas, the Tenth Amendment to the Constitution of the United States reads, “The powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the people”; and

Whereas, the Tenth Amendment defines the total scope of federal power as being that specifically granted by the U.S. Constitution and no more; and

Whereas, as the scope of power is defined by the Tenth Amendment, the federal government was created by the states specifically to be an agent of the states; and

Whereas, today the states are demonstrably treated as agents of the federal government; and

Whereas, the legislature has forwarded to the federal government numerous resolutions opposing federal encroachment on state powers but has received no response or result from Congress or the federal government; and

Whereas, many federal mandates are directly in violation of the Tenth Amendment to the Constitution of the United States; and

Whereas, the U.S. Supreme Court has ruled in New York v. United States, 112 S. Ct. 2408 (1992) that Congress may not simply commandeer the legislative and regulatory processes of the states; and

Whereas, a number of federal proposals from previous administrations and some now pending from the present administration and from Congress may further violate the U.S. Constitution; now, therefore, be it

Resolved by the senate, That the senate hereby claims sovereignty under the Tenth Amendment to the Constitution of the United States over all powers not otherwise enumerated and granted to the federal government by the U.S.Constitution; and, be it further

Resolved, That adoption of this resolution does not constitute an application for the calling of a federal Constitutional Convention within the meaning of Article V of the U.S. Constitution; and, be it further

Resolved, That this resolution shall serve as notice and demand to the federal government, as our agent, to cease and desist, effective immediately, mandates that are beyond the scope of its constitutionally delegated powers; and, be it further

Resolved, That the senate chief clerk shall provide copies of this joint resolution to the president of the United States, to the speaker of the U.S. House of Representatives, to the presiding officer of each house of each state legislature of the United States, and to each member of this state’s congressional delegation.

Amen. Lets get Wisconsin to be the first state to secede. We can get by just fine without the federal government telling us what to do. Stand up Wisconsin, tell your neighbors, call your representatives. Who cares if the feds pull our highway funding, we don't need them. Lets get something going.

US Constitution is clear, the Fed has only specific powers. The State must maintain it's powers and rights or loose them.

You've got that right, Bruce! The People are the sovereign in the American system and governments - whether state or federal - only have powers. And they only have the powers that the People delegate to them.

Those that love this country need to take note. People like Communal Prosperity should scare the crap out of people. Individuals like him are useful though. They are what you get when you pull the very thin cover off of the left-wingnuts like Obama and Pelosi. Communal Prosperity's views are exactly where the Obamanista's and Pelosi socialist reform movement wants the United States to go.
You must contact your representatives and let your views be known. While our country may have issues that need to be addressed, we cannot let this "Hope and Change" circus destroy what so many have died to protect.

Glad I found this site. Read the text of the Wisconsin amendment on Campaign for Liberty. A real good statrt, although I wish they go further and refuse any categorical aids from Washington DC, and leave open the prospect of secession from the union if such oppression continues. That may be something down the road, but the resolution is a strong move to keep such blatant power grabs as FOCA, the Hate Crime act, and nationalized health care. Doubt if the liberal Democrat majority on the State Affairs committee, or their majorities in the legislature, will pass this, unless we put a lot of pressure on them via emails and phone calls, and more tea parties. The LPWI (my political party) and the Constitution Party need to support this openly and aggressively. Our best hope to take back power from the fascist/socialist power grabbers in Dc (in both major parties!)

Congrats to the WI leaders who are responsible for this Amendment. The response of Community Prosperity is an example of the blind allegance that many Americans have to Obama. He's the first black president, he's anti-Bush, he's for all kinds of Socialist garbage, which the "takers" in American think they are entitled to. Our only option is to get rid of as many as we can in two years and the rest in the next presidential election. If that is not done then I vote for seceding from the Union and forming another country where reason prevails. Fed Up.

Nobody makes the right's point better than the left: Thanks, Communal Prosperity, for pointing out that, to leftist extremists (i.e. Obama), adhering to the U.S. Constitution is "extremist activity"! The Federal government has been overstepping its bounds for a long time now.

The last thing this country needs is to end up being a nationalized communist toilet bowl. End the federal force-fed socialism and stand up for your rights!

It is very obvious that Communal Prosperity (the very name makes me gag) has not and likely will not ever read the Constitution.

If you do not like what the Founders created, please leave. I'm sure that Cuba's "Communal Prosperity" will be more to your liking.

This is exactly the rightwing extremist activity that the Department of Homeland Security is warning law enforcement officials about. If the states would sit back and allow Obama to implement his plan, everyone will be all the better in the long run. We need Nationalization to be more like the European Countries. It is time to let go of Bush oppression and move forward and embrace change. Obama is the answer we just have to be willing to listen.
