Tennessee Balance of Powers Act

The “Tennessee Balance of Powers Act” is moving forward in the TN legislature! This is critical “states rights” legislation drafted by Liberty Legal Foundation and designed be a model for every state in the nation to protect its citizens against unconstitutional Federal laws.

The “Tennessee Balance of Powers Act” acknowledges that the State has an ongoing duty to defend the rights of Tennesseans against federal abuses of authority. Since our country’s founding states have left it to citizens to correct federal abuses of authority. Citizens usually have to allow the federal government to violate their Constitutional rights in order to have standing to challenge a federal law. Then the individual private citizen is left to take on the entire federal government, by themselves, in federal court.

The “Tennessee Balance of Powers Act” will change that paradigm. It will allow the State of Tennessee to file original challenges directly with the U.S. Supreme Court before anyone’s rights are violated. Note that the Supreme Court has no discretion to refuse such cases. Such challenges will be limited to instances where Congress passes laws that are clearly in violation of the Constitution. Such challenges will greatly enhance Congresses respect for the Constitution, and will re-assert state authority over the federal government, pursuant to the Constitution.

 @NAVSOG An interesting article indeed. Nullification isn't possible if a law is unconstitutional to begin with and the argument that all gun laws are unconstitutional I would believe is true. So long as states have enacted an balance of powers act. I have known that the law schools and supreme court have gone overboard against the Constitution I didn't realize the extent to which the Supreme Court had attempted to set itself up as an Oligarchy and therefore the 'supreme law of the land'. First let me say Thank You from the bottom of my heart. I am a Viet Vet, Gun owner, SAF, NGAR, GOA Member and NRA Member. I with the recent massive attack's upon our liberties and Freedom's have joined the Oathkeeper's  Tea Party(since2008) Tenther's and Constitutional Sheriff's. Am trying to help with the fight as much as possible. I live in New York and you are well aware of the unconstitutional action's of the rat in the Governor's mansion here. We fight and if need be WE FIGHT, I shall never serve on my knees. I know being in California you are surrounded with the liberal think and it certainly has to be difficult at best. United we Stand divided we are turned into sheeple.

Have you heard of Operation Inaction?

Here's an idea: Do nothing. Sit at home and chill. Don't go out to eat, don't go to the movies, shopping, work, school, don't drive your car, don't do anything! Just stock up on a month's worth of supplies, like food, medications - those regular things you'll need - and do nothing. If more than half the United States does this all at the same time, can you imagine what would happen to the economy? Can you imagine the sort  of response that would be triggered? What's even better is that this isn't violent in any way. It's a silent message. It's not even rebellion. But it will get their attention in as little as one week's  time.

There have been studies made on how the country would be affected if just a smallpox outbreak was reported at several key transportation areas like JFK, O'Hare, etc. Think of what it would do - how your voice WOULD be heard if you were to DO NOTHING for just one week. Two weeks or even one month.All that's necessary is to do absolutely nothing - don't fly - don't drive or ride a bus or even a subway. Don't leave your home to go to work or shopping - don't send your kids to school - don't pay your bills - don't do anything. If you are a health care provider - a nurse or doctor - don't go back to your normal duties because once you have all shut down and are not doing your normal activities the beast will be forced to send in its military personnel to staff regular civilian duties until they end the Country's strike.

But in order to bring this beast to its knees you will need the vast majority of people to follow suit. In one weeks time - just 7 days of no activity the President will be urging every American to go back to work and their normal activities. In two weeks time he will be begging you - and in one month the government will be in such dire strait they will be willing to listen to the people's voice. All done without firing a shot or any kind of violence - simply unify and DO NOTHING until the beast is brought to its knees by your inaction.

Re:        SB1112 – 2nd Amendment Preservation Act

Senators of the State of Arizona:

Reported: Senators Adam Driggs and John McComish are preventing SB 1112, The 2nd Amendment Preservation Bill, from being considered by the full Arizona Senate.  They “believe it is ‘unconstitutional’ for Arizona to pass a Law that bans the federal government from violating the 2nd Amendment.”

Apparently Senators Driggs and McComish are unfamiliar with the U.S. Constitution although both took a required Oath to support it.  They seem unaware the Constitution has been ratified by all States as the supreme Law of the Land.  Article VI, states that to be valid, any Laws and Treaties must be made “under the AUTHORITY of the United States”:…State Constitutions and Laws contrary to the U.S. Constitution are invalid. 

If Senators Driggs and McComish still lack understanding, the “Authority” of the United States is only that which is enumerated in the Constitution, granted by ‘consent of the governed’ (the Militia.)  Therefore, any Executive, legislative or judicial Member of either the federal or State government(s) who ‘violates’ the Constitution is guilty of malfeasance of office, and of treason.

Arizonans expect our State Legislature to protect us from the federal government’s unlawful intent to diminish and/or remove the 2nd Amendment’s ‘unalienable’ “RIGHT OF THE PEOPLE TO KEEP AND BEAR ARMS, SHALL NOT BE INFRINGED.”  We also expect our Governor and State Legislature to actively nullify any and ALL unconstitutional Laws by federal government that increasingly governs outside the ‘limits’ of the Constitution.

No longer a silent majority, we expect legislation under the Authority of the U.S. and Arizona Constitutions, rather than complicit with the loud will of various special interest groups.  Representatives, either federal or State, who violate our Constitutional Rights and Laws and seek to remove the ‘unalienable Rights endowed by our Creator deserve the fruits of their perfidy.  We are watching; we WILL act.
