Texas House to Feds: Back Off

After being nearly derailed on a technicality earlier this month, Texas House Concurrent Resolution 50 (HCR50) was brought back for a vote today, and passed by a wide margin.

The resolution affirms that “the State of Texas claims sovereignty under the Tenth Amendment to the Constitution of the United States over all powers not otherwise enumerated and granted to the federal government by the U.S. Constitution, serving notice to the federal government to cease and desist certain mandates, and providing that certain federal legislation be prohibited or repealed.”

The final vote was 99-36. (click here to see the tally)

Here’s the full text of the resolution:

WHEREAS, The Tenth Amendment to the Constitution of the United States reads as follows: “The powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the people”; and

WHEREAS, The Tenth Amendment defines the total scope of federal power as being that specifically granted by the Constitution of the United States and no more; and

WHEREAS, The scope of power defined by the Tenth Amendment means that the federal government was created by the states specifically to be an agent of the states; and

WHEREAS, Today, in 2009, the states are demonstrably treated as agents of the federal government; and

WHEREAS, Many federal laws are directly in violation of the Tenth Amendment to the Constitution of the United States; and

WHEREAS, The Tenth Amendment assures that we, the people of the United States of America and each sovereign state in the Union of States, now have, and have always had, rights the federal government may not usurp; and

WHEREAS, Section 4, Article IV, of the Constitution says, “The United States shall guarantee to every State in this Union a Republican Form of Government,” and the Ninth Amendment states that “The enumeration in the Constitution, of certain rights, shall not be construed to deny or disparage others retained by the people”; and

WHEREAS, The United States Supreme Court has ruled in New York v. United States, 112 S. Ct. 2408 (1992), that congress may not simply commandeer the legislative and regulatory processes of the states; and

WHEREAS, A number of proposals from previous administrations and some now pending from the present administration and from congress may further violate the Constitution of the United States; now, therefore, be it

RESOLVED, That the 81st Legislature of the State of Texas hereby claim sovereignty under the Tenth Amendment to the Constitution of the United States over all powers not otherwise enumerated and granted to the federal government by the Constitution of the United States; and, be it further

RESOLVED, That this serve as notice and demand to the federal government, as our agent, to cease and desist, effective immediately, mandates that are beyond the scope of these constitutionally delegated powers; and, be it further

RESOLVED, That all compulsory federal legislation that directs states to comply under threat of civil or criminal penalties or sanctions or that requires states to pass legislation or lose federal funding be prohibited or repealed; and, be it further

RESOLVED, That the Texas secretary of state forward official copies of this resolution to the president of the United States, to the speaker of the house of representatives and the president of the senate of the United States Congress, and to all the members of the Texas delegation to the congress with the request that this resolution be officially entered in the Congressional Record as a memorial to the Congress of the United States of America.

    I don’t see things as having a tight deadline. Even if this doesn’t pass all the way through this session, it’s building momentum for the long run. I see the beginnings of a great movement towards constitutional, as opposed to unlimited, government in the coming years.

    As far as the Senate’s concerned, is the bill merely out-of-committee? What are the chances that they will vote on it Sunday, since Monday apparently is merely an administrative day without such voting? Hopefully they’ll pass the same version as the House? Rick Perry would likely sign it if given the chance.

    I am having a HCR-50 cookout tomorrow I’m so excited! I know it’s just a piece of paper, and the president will just ignore it, like he has all the other 33 states – but you are right Michael the momentum is building, MSM will not tell you about it, but it’s there I feel it!

    It’s not just a piece of paper, and the ‘president’ most assuredly will not ignore it, anymore than he’s ignored the movement to date, including the Tax Day (and future) TEA rallies. Notwithstanding what he says in public. Actions speak a whole lot louder than words.

    I love it, only the States have the power to get Washington’s attention. And I am with Janis “Whoo hoo! God Bless Texas,” however we had best not forget Isaiah 60:12 “For the nation and kingdom that will not serve thee shall perish; yea, those nations shall be utterly wasted.” As long as we persist in being the modern version of Sodom we can’t expect God to bless us.

    They couldn’t win any election so now the richest most empowered state through the corruption in DC the past 14 plus years doesn’t like being governed by the elected government of our country. I say give Texas to Mexico. Let them cook up their magic there and leave us the hell alone. Big Oil and CIA aka G H W Bush had their shot and messed it up for the rest of us while they laugh all the way to the bank. Many of the rich companies and corporations are based in Texas some with offshore offices that contain a desk and phone. They do not pay their fair share of taxes. They just complain about the little bit they do pay going to our poorer citizens. Remove a star from the flag. It’s one of the dirtiest and most corrupt star. There is so much capital in Texas one wonders if they’ll ever succeed. They won’t because We the suckers would no longer shovel out our dollars to them to hide and rob us of things like our pensions and Social Security.

    Did Texas not create over 70% of new U.S. jobs last year? Is Texas not a tax-DONOR state, paying more in taxes to D.C. than it gets back? Is it not surprising that D.C. conditions the return of some of that money, through a stimulus package (that’s not stimulating much more than government bureaucracy and political fat-cat union bosses) on Texas’ adopting 3rd World labor protections that make it a less attractive place to do business? And then you criticize its entrepreneurs for wanting to do business in lower tax nations featured at http://www.lowtax.net ? Texas has no state income tax and some hate it for that as well. Texas used to be its own country, and needs to revisit that progressive element of its history. Most of its younger residents won’t get to collect social security even as they pay into that rip-off socialist program to prop up lazy people elsewhere in the country who vote for their own entitlements, and the decline of the [Roman] empire…

    Interesting that there was mention of NY vs. US…probably a slap back at Congress for passing the stimulus bill containing language, that granted State legislatures the ability to accept the federal $ over the objections of their State Governor. Not only did it violate the 10th amendment, but it also attempted to usurp State constitutions and State sovereignty.

    I agree that this is wonderful if it works. My question is how much weight will this bill carry when Perry just accepted 20 mil to repair the capital?
    Sadly that money puts him back under their control, does it not?

    Which I believe was the issue of some States not accepting any bailout funds in the first place.

    I’m happy that, even if the current administration ignores this, 99 representatives have listened to my frustration and are standing up for my constitutional rights!

    In 2008, Texas created more jobs than all the other 49 states combined. But the current administration is trying to ruin our ability to attract new business with the American Clean Energy and Security Act of 2009. It is a gift of our industries to China and India. The worst part about it is, it doesn’t work.

    Cap & Trade hasn’t lowered emissions where it has been implemented, but it sure has increased unemployment. Look at Spain; 17% unempoyment! Businesses just passes the cost on to the consumer and the poor pay disproportianately.

    I hope HCR 50 empowers us to resist this devestating legislation.

    it is great to see something positive happening. we just need all of the states to come together, as a union as we are suppose with the addition of the other 17 to make it unanimous! stay on ‘em about this climate change propaganda too. the people that support gore and the un are outnumbered 30 to 1 so it must be bullshit. watch out for ‘em sneaking in gun laws to all bills too!

    Didn’t you know? Our federal government did give us to Mexico. We’re inundated with illegal aliens, which are sinking our schools and hospitals. The federal government prosecutes and jails our agents who try to defend the border. They want Mexico and Canada and the U.S. to merge and leaving the borders open on both ends is the easiest way to do it.

    The main function of the federal government is to protect us from foreign invasion. Why should we continue to support this tyrranical government?

It’s time after all these years for the vote to be brought to the people of Texas. The most wonderful thing about this great state is that, unlike with the US, WE HAVE A VOICE!!! Whether its yea or nay, lets bring the vote. If we dont do something NOW, we might not have a choice or state to call home later. I am only 33 years old, and have never been scared for mine and my childrens future as I am now. Obama and the present administration make Clinton look like a greek god.     As a native of the Republic of Texas I say WOO HOO BABY! I am now a resident of Oklahoma … another state pushing ofr similar resolution at the command of state rep. Charles Key. This has NOTHING to do with secession…but has to do with the fact that states are sovereign according to the 10th! Deal with it liberal loons that want to dictate every move free people make.

    The leftist puke filled maggots that are appalled at these measures are utterly clueless to the reality of the Constitution of the United States and how the union was originally formed. Who created whom? Did the Federal Goernmetn create the states or did the states create the Federal government to serve them?     This bill does not mean that tomorrow we secede – but if the federal government ignores it and the other states passing similar resolutions then we have one more action to point to if we do decide to secede. I love the wording in the Texs resolution – to cease and desist! The federal government is supposed to be working for us – and not the opposite – but unfortunately that’s exactly what has been happening for years. Obama didn’t start this – but boy he sure has perfected it in just a few short months. The feds ignore us at their peril.

I have emailed Rick Perry several times, words of thanks and praise for his stand to keep the federal government’s hands off Texas. I also have asked him to close our borders to illegal immigration. I’m not opposed to legal immigration, having lived with Americans of Mexican heritage. Good hard working folks, like most Texans. To see this, as well as to see the possiblity of a Republic of Texas makes me so happy. How wonderful if we can stop the corruptive influence of the United States of Big City America and the United Nations. We, as Texans, can make a wonderful place to live that shining city on a hill that Ronald Reagan always proclaimed. As a retired serviceman, if we have to step back and become the Republic of Texas again, I commit myself to the defense of Texas from all enemies, foreign and Washington DC.

    We are moving to Texas next week, and this is just one of the reasons why. I want to live in a state that holds CONSERVATIVE VALUES high and commits to living right. I look forward to being called a Texan, even if not by birth. I will get involved in supporting the conservative movement like I I have done in Louisiana.

      Jimmy, this passed the TX house, but the session closed for the year before the Senate had a chance to vote for it. We recommend that you contact Rep Brandon Creighton and others in the TX government to ask them to press this issue again when they resume.

    This is the best news I’ve had in years. We are tired of Washington creating crises so the Federal Government can infringe on our rights and the free market economy.

    I say it’s about time the states restated their rights and sovereignty.

    We are also tired of bailing out states like California with all their “progressive” (liberal) ideas. Texas is too proud and too strong to be bullied into submission by big brother in Washington.

    Right on GoTexas. Since the Gov.t wants it’s federal borders open, let’s close the state borders. Everyone stop paying federal tax, if the state taxes income then the federal can’t – double dipping. Only states without income tax should have to pay federal, and at no more than the highest state out there.

    There are certain rules that should apply everywhere:
    - Consensual Cannot be Criminal
    - Rambo’s First Blood Rule
    - You break it You buy it
