The sheriff's authority doesn't come from the constitution, federal OR state. His (or her!) authority comes from the militia of the county, which is all the men capable of bearing arms. Including women when necessary, under male headship. And the men of the county aren't ultimately the source of authority because they aren't to be "loose cannons" in matters of defense, but are to look to their Maker for all their powers. Any unwilling to be under Divine authority must be as children, incapable of their own defense.

One of the most foul smelling things I have been aware of here in California was the instances of state personnel being used in Federal medical marijuana raids, when the state did not even see them as a crime. Indeed Monorprise, it should be a top priority of our movement to ensure that our state legislators not only stand up to DC, but also back our county Sherriffs.

Exactly! The key is to ensure that sheriffs not only know this fact, but have the courage to do something about it. The latter will take a lot of popular support from people in their respective counties.

The question we should be asking is how can the state legislator help empower and protect the Sheriff and other such local agents, and in doing so better empower it's people to defend themselves and their rights lawfully?

One thing we need to make sure of is that the State forces will NOT help the Federal government against any of the State's county sherifs protecting their Citizen Constitutional rights. In fact we should be doing everything we can to insure that unless the State determinant that the sheriff is in the wrong, the State stands in aid of the sheriffs when, where, and if necessary.

Perhaps if it does not already exist, a duty a system should be put into place in which the State can send reinforcements and take up the Sheriffs Constitutional cause in a more official and powerful capacity.

The more local we make this stand the more representative it will be of the will and sentiment of the people.

That is not to say that the legislator and governor should be leaving this entirely to the country sheriff, the sheriff is simply one of many agents of interposition. The State itself must take additional steps in its own state wide nullification to compel the local police and sheriffs into ignoring and if necessary apposing unconstitutional federal usurpation.

What an honor it is for me as an Arizonan to have Sheriff Mack as one of this country's most important champions of the 10th Amendment and state sovereignty. Listening to this podcast really inspired and encouraged me. It's as if everything is really coming together.

Where does the Sheriff get his power?

I don't know what the Federal Government is going to do about the Good Sheriff. Sheriffs are Constitutional officers, not U. S. Constitution but State Constitution.

The people created the Constitution which empowers the Federal government to protect the people. Also, he Tenth Amendment reserves to the states respectively, or to the people, any powers the Constitution did not delegate to the United States, nor prohibit the states from exercising.

The office of sheriff is created by the Constitution of the Great State of Arizona. The sheriff is bound by the oath to uphold the Constitution of the state and answerable only to the people of the county NOT the Federal Government. The office of sheriff IS a part of the checks and balances of the United States of America. It is there to prevent the Federal Government from doing what it is trying to do today.

So what is the Federal Government going to do? Amend the Arizona State Constitution? I think not.
