States’ Rights Hypocrites Emerge

One of the stupidest attacks on advocates of the Tenth Amendment that I’ve recently seen was written by Brian Hicks and published in The (Charleston) Post and Courier on March 20. According to Hicks, South Carolina state legislators who are paying undue attention to the Tenth Amendment are “a bunch of guys obsessed with nineteenth century history” but “haven’t learned much from it.”

“The last time they got uppity and began mouthing off about states’ rights, we got our butts kicked.” Hicks goes on to explain that states’ rights really mean for most of its proponents the “race issue.”

And even before that became the case, according to one history professor at the College of Charleston, the term “has a tragic history in the life of our state. It harks pretty clearly to the nullification controversy. It began with the unsuccessful attempt of South Carolinian to resist the high tariff signed into laws by Andrew Jackson in 1832 and ended in disaster. The controversy dragged on for a couple of years, egged on by John C. Calhoun, until the state finally backed down.” But “resident busybodies didn’t shut up and kept fanning the flames until finally they just decided to secede. And we all know how that turned out.”

Yes, we all know how that turned out. Since the defeat of the secessionist South in 1865, the feds have been in charge of the military means of making any defiant state government compliant with its orders.

Therefore, it was only a matter of time before we reached our current condition, in which the states became only submissive tools for carrying out the will of a centralized federal administration (which in fact has no constitutional standing except as an indeterminate extension of executive power).

This, by the way, has nothing to do with defending the institution of slavery, which we are certainly well rid off. It’s about a growing federal bureaucratic dictatorship, which neither of our two publicly financed national parties is willing to touch.

For Hicks’s information, James Madison, one of the authors of the Constitution, defended the doctrine of nullification, most famously in the Virginia and Kentucky Resolutions of 1798. The notion that state governments could “interpose” themselves between an odious federal law, as were the bloated tariffs of 1828 and 1832, and the citizens of their states has a pedigree going back to the late eighteenth century.

The authors of the Tenth Amendment clearly believed in the right of nullification, and if Jackson put down the resistance to it mounted by the residents of the seaport of Charleston, he did so by threatening military force. He was not making a constitutional argument of any kind.

There is one point on which Hicks may be correct, namely that South Carolina Republicans who are unhappy about usurpations of power under Barack Obama did not seem to care when “the last administration was stripping away all our constitutional rights with the Patriot Act.”

But there are two obvious responses to this partly justified charge. One, for many decades all kinds of supposed defenders of states’ rights have invoked this principle quite selectively. If New Deal-Great Society Democrats discovered the Tenth Amendment when they were opposing the racial integration of public and private institutions in Southern states, the putative allies of Mr. Hicks are at least as hypocritical when they scream states’ rights in order to allow gay marriage and the legal use of marijuana.

How can Hicks be so blind to the fact that it is liberal Democrats who are out in front in the hypocritical appeal to states’ rights on behalf of their socially liberal agenda?

Two, it is simply untrue that those who favor a new emphasis on the Tenth Amendment are all fans of the Bush administration and its liberal internationalist foreign policy. Certainly this judgment would not apply to Ron Paul, Chuck Baldwin or the millions of followers of these recent presidential candidates.

The Constitution Party, the Campaign for Liberty and other groups that are part of the Tenth Amendment movement are overwhelmingly composed of critics of the Bush administration. While there may be GOP politicians who have climbed on board, most of the Republican supporters I’ve met do not strike me as stand-ins for Karl Rove and John McCain.

Moreover, it is possible that some Republican legislators did vote for the Patriot Act because they were genuinely concerned about national security after 9/11. This vote does not mean these legislators also favored a further extension of the federal administration into such domestic matters as social policy and taxation.

On the other side, however, are the assorted hypocrites in Hicks’ camp, who complain about federal surveillance in dealing with terrorism but who adore federal snooping to uncover “discriminatory” business practices and “gender-discrimination,” or to regulate the flow and direction of tobacco smoke.

Why is having the ATF or another part of the federal government control our smoking or hiring habits any less of a federal interference than the Patriot Act? The answer is of course self-evident. All forms of federal interference that serve the ideological ends of people like Mr. Hicks are perfectly acceptable.

    We, the people are concerned about the political and economic conditions of the great State of Michigan and the Nation. The turn of events in American policies over the last 20 years has moved us miles away from the Constitutional Republican government, which was gifted us by our founders. We are now facing a pseudo European socialistic model, and with the collection of presidential orders awaiting implementation, we could, in short fashion, be facing Fascism. With the onslaught of unfunded or half funded mandates for various socialistic programs brought on since the advent of the New Deal, and more recently, with the outlandish spending sprees by former President Bush and the now President Obama, the debt of America is in the stratosphere; some estimate to be in the neighborhood of $100 trillion. The Federal government’s actions of coercing the states to implement Federal mandates in exchange for the returning of monies collected from the citizens and businesses in Michigan is surely unconstitutional and yet, our state leadership allows this blackmailing to continue. If one considers the Federalist Papers and our resulting Constitution, it can confidently be argued, the Federal government has overstepped its governing authority in almost every aspect of our lives, and we the people and our state leaders over the years have allowed these transgressions of states rights. We are sure that many of our founders such as Madison, Jefferson, Paine, and Washington would have taken up arms long before now.

    As such, we demand our state leadership to support and pass legislations such as those introduced by Michigan State Senator Patterson bills such as SCR 4 and SR 17. Rep Opsommer HCR4, HCR6, HCR9, HCR14, Rep Knollenberg HR70, Rep Byrun HR47. These bills have inspired a few of us at the grassroots level . We have recently created a series of social web sites such as Michigan Stands for State Sovereignty that focus on tracking the various sovereignty resolutions and bills introduced in each of the several states. It is time for the citizens and the leaders of the several states to tame Washington DC and return the power of governance to its rightful owners, that is, to the people of the several states. We are confident that if our state leaders put their thinking caps on, that you and others will conceive and enact laws to prevent further encroachment upon states rights, and perhaps reclaim some of the rights that our state has seemingly relinquished control over to the Federal Government. There are a couple of good examples of forward thinking legislation in MI Rep Opsommers introduction of HB 4783 and HB 4653.

    We, the citizens have additional concerns about the DC encroachment upon additional personal and state liberties, which need to protect the citizens at the state level by preventing Washington DC from:

    I. Establishing martial law or a state of emergency within one of the States comprising the United States of America without the consent of the legislature of that State.

    II. Requiring involuntary servitude, or governmental service other than a draft during a declared war, or pursuant to, or as an alternative to, incarceration after due process of law.

    III. Requiring involuntary servitude or governmental service of persons under the age of 18 other than pursuant to, or as an alternative to, incarceration after due process of law.

    IV. Surrendering any power delegated or not delegated to any corporation or foreign government.

    V. Any act regarding religion; further limitations on freedom of political speech; or further limitations on freedom of the press.

    VI. Further infringements on the right to keep and bear arms including prohibitions of type or quantity of arms or ammunition.

    VII Further nationalization of health care.

    The American experiment was carefully crafted to allow the citizens the opportunity to maintain a balance of powers between the various branches of government. From our point of view, this balance, particularly at the Federal level, is no longer in place. We ask you and the other leaders of the great State of Michigan, to be bold in your leadership role and help reclaim our State Sovereignty and our Constitutional Republican form of government. As was stated by several observers: the Stimulus plan is not a stimulus for Michigan and we need to appeal to all the good citizens of Michigan to work together and put us on the track of common sense and liberty. It should be clear to all, we cannot depend on DC to deliver us from our economic problems, and many at the federal level certainly do not seem to be concerned about our individual sovereign liberties. The strength and answers for Michigan and America rests with we the people. Now is a crucial time in our history. Perhaps it is time to think a bit outside of the box… government for the people and by the people.

    As a wise man once said: the bill of rights is a misnomer; It should be called: the bill of responsibilities. We are confident that the state of Michigan and the Nation will rise up stronger than ever with that ideal and with your help and the help of all of our fellow citizens.

    As a final note: Over 200 years ago, the father of our Constitution, James Madison wrote: “To preserve the Republic, it is in the hands of the people. We have staked the whole future of American civilization not upon the power of government, far from it. We have staked the future of all of our political institutions upon the capacity of mankind for self-government; upon the capacity of each and all of us to govern ourselves, to control ourselves, to sustain ourselves according to the Ten Commandments”.

    The constituents of MI demand action on the above named issues and protection from all others federal encroachments in the future involving constitutional State and Individual Sovereignty!

    Mr. Hicks is obviously one of those media zombies who relate everything to race. Its time to wake up Mr. Hicks. Slavery is long gone and I do not know a songle pro-slavery person today. The race card worked well for the Obama team during his run but it is a dad horse now. The simple truth is states rights are the rights of the people and have never willingly been given to the Federal Gov. The Federal Gov. has so slowly taken control of all social, legal and economic issues that affect us all, that it has happened while we watched and were still unaware. We are now awake and aware Mr. Hicks. We the people know our local and state needs much better than the Federal Gov. running our lives from their high perch in Washington and that my friend has nothing to do with race. All races and genders have equal rights and the Tenth Amendment movement has come about because its time We the People took back control of our lives and the US and State Constitutions give us that right. Having local control of our destiny does not mean we will be at war with other states. To the contrary it will means we will have many more idea’s and opportunites to partner and assure every American the very best opportunity to be a part of this great country. You Mr. Hicks are part of the problem.

    Mr. Hick’s appears to be a historian and very knowledgeable but a 19th century history lesson is not what the people need, they need the truth.Americans were mislead by a campaign slogan of “Yes We Can” promises from a non-Messiah and the use of a slick Willy race card that threatened your right to challenge issues. Yes We Can means illegal immigration has a pass, the fall of the Unions and American jobs,a 957 trillion dollar deficit and growing, a 500 billion yearly interest rate, and a Senate and Congress majority who go with the flo. Folks the ear mark train is alive and well I assure you. I would like to see Mr. Hick’s leave the classroom and ask the people of Weat Virginia if they know what New World Order is? Do they realize we have a “little Mecca” in Tennessee that is growing and claiming neighborhoods? They are even sueing over church bells ringing in a local church because it annoys them and they won. A former Polish neighborhood has now given way to Islam. Have you mentioned the thirty five terrorists camps in the US? Do you realize Senator Rockfeller is workng on a bill called the Cyber Security Act 2009 that will give the government complete access to the internet and they can shut it down? Watch that personal information because it will not be personal if this bill goes through.We are loosing our freedoms and freedom of speech is under attack and conservative radio and television. We are moving from a free society and country to a global Socialist order defined as Fascism. I urge the citizens of my state to start investigating what the liberal media and newspapers do not want you to know. Dare to question authority and reject the domination of your children by textbooks that support the Socialist regime or the UN who wants to replace parental control with domination with their new policies. The issue of State Sovereignty is vital in maintaining the America we know and love or you can accept the alternative of sitting at home with an RFD implant,removal of your right to bare arms, and complete control of your lives and your wages. It is up to you. Look up some internet sites like We the People, The Conservative Underground,Freedom Congress,Resist.net,Restore the Republic,to name a few and get informed before it is to late.

    Paul’s article looks to me like another political (issue) carrot dangling in front of a donkey Citizenry to keep pulling this wagon for a criminal unconstitutional regime.

    I truly wonder it the Citizenry will ever wake up and or what will it take to wake it up?

    I find the only purpose of political issues is to mislead the citizenry.

    What political issue does the citizenry have the Right and power to decide, one way or the other? Consider the citizenry cannot make a law; reference Article I, Section 1, of the Constitution. Then consider exactly what Right and power the citizenry does have; reference Article I, Section 2, the Right and power of the ballot box. Then consider the last paragraph of Article VI.

    So, the only political issue the citizenry has the Right with power to decide is who gets elected (hired) to Legislate. And the only thing the citizenry can constitutionally hold Lawmakers to is the Oath of Office. Constitutionally elected Officials cannot be elected to do anything else, or cannot be elected for any other reason.

    Jim Neubacher wrote an excellent article in reply to Paul’s article and I only ask Jim to reconsider some of the wording a bit and give a bit more definition of powers (citizen powers).

    That statement is right on, but I would consider changing the word “allow” to something like “empower” then define that power. Of course that defined power over government is written in Article, I, Section 2 as the power of an Employer – to hire and can fire elected Officials and do so every two years for Members of the House of Congress.

    If you don’t like the legislation your Congressman has burdened you with then Fire him – you have no other constitutional recourse to get that situation corrected.

    Let us get down to the brass tacks and call a spade a spade so we know where we now stand! Among those that have kept an alert watch on humanity’s worst nightmare, Communism, they realize that it NEVER came down with the Berlin wall, as the controlled major media touted so loudly! They just hid under the name of liberalism and continued their destructive work within America. The majority of Americans never even realized the damage being so quietly done, even until this very day, by the RED termites eating away at American’s minds and most strategic infrastructure! Now as America’s once-strong beams begin to fall through the ceiling the RED, Communist termites can clearly be seen for what and who they are: COMMUNISTS! At this now late hour there is no time to attempt to wake up the majority of dead-heads in this country by attempting to “educate” them with long past history in order to bring them up to date. We must get down to SIMPLE FACTS in order to awaken them to their impending peril! Simply give them a copy of the “CONGRESSIONAL RECORD 1963 COMMUNIST GOALS” so they can see for themselves how many of the 45 goals have already been met AND the ones pending!     criminal unconstitutional regime?? Alan you took the long way around to say exactly nothing. Everyone on this site with the exception of you it seems is aware that we have no direct discourse in the making of our laws. We do however have the power to elect (which to your credit seems to be your only point) the type of people who will follow our wishes. With any politican your taking a chance that they will do as they promise. I give you President Obama as a prime example. Bush was bad but Obama is terrible. I don’t blame either of these two for the state of our affairs. This has been going on for decades. It has now reached the point where the American people see that something can be done. We have much more control in electing state politicans than we do of swaying the federal gov. That is what the Tenth Amendment gives us the right and yes the power to do. A few hundred heads from no particular party can do a much better job than several hundred from the same party in Washington no matter which party it is.

    No, BK, the American people DON’T CARE. The average citizen doesn’t know jack about our procedures and policies. They see things in black and white, democrat and republican. They don’t understand what a political party really is. They take something that a professional liar says as fact and run with it.

    I wish more people would wake up and realize what is happening, has happened, and will happen. Fact of the matter is, they won’t as long as our current system is in place. People have been purchased with federal money through illegal programs. That is what is keeping the wrong people in power.

    Your statement is “constitutionally” silly and Democracy correct.

    The People cannot amend, much less change, the Constitution. The Constitution demands all elected Officials, and all Judges, take an Oath to support the Constitution and are not in any way obligated to honor any other “wish” of the People.

    Constitutionally silly again with “That is what the Tenth Amendment gives us the right and yes the power to do.” – The Tenth doesn’t give you or the People any Right or Power at all. As a matter of fact the whole Constitution doesn’t give the people any Right and or Power, unless it is that of Employer of elected Officials with the Right and Power to hire and fire them in Article I, Section 2.

    ANTICRIME,

    To correct government the Constitution and the Duty in Citizenship is the only thing the People need to learn (and know and “enforce”). I’ll wager you have no clue what the Duty in Citizenship is. I’ll give you a clue;

    Read with comprehension, Article I, Section 2, of the Constitution and Amendments 5, 6, and 7, of the Bill of Rights.

The right to self govern (according to the tenants of the Constitution of course)without undue interference. What part of “Shall make no law” is unclear to you?

    I am ignorant of any guarantees the Constitution makes to us, please explain and quote from the Constitution.

    By the last election, reelecting nearly 100% of the criminals in the House of Congress, I have to believe the Voters do not want any Rights and Freedom.

    I post to a number of groups and the usual reply I get is they love their unconstitutional Democracy. They really think government honors their petitions, marches, and protests. Of course government does honor them ….as long as the unconstitutional request is what government wanted to do in the first place.

    Government did honor the civil rights marches didn’t it – then why didn’t government honor the Bonus Soldiers protest? Have you thought about it?

    Just for clarity as I am not picking side in this discussion as of yet.

    Article IV Section 2:
    The Citizens of each State shall be entitled to all Priveleges and Immunities of Citizens of the several States.

    Article IV Section 4
    The United States shall guarantee to every State in this Union a Republican Form of Government…

    There’s at least one guarantee there. Seems to me that our Lower (aka Federal) Government is most certainly in violation of Section 4 with all of the “Do it or loose funding” programs they’ve pushed over the years.

    For my part I hope this site is for open and honest discussion among Americans because the subject matter is of the most importance to all Americans. And IMO sticking to the subject matter is not taking sides.

    Yes, you found one guarantee to the States, good for you, thanks.

    It is my understanding the 1787 Constitution is not about the people or their Rights but about a government of a country. Even the Bill of Rights is not about the People, if it were about the People it would be unconstitutional. The Bill of Right forbids U.S. governments any jurisdiction over the people. The Constitution makes no demands on the People except those elected to government positions and then only in their official capacity (shall make no law, shall not infringe, etc.).

    The Constitution creates a federal government to protect the physical USA, settle squabbles between the States, and domestically very little else. In this context the People might consider the USA as their playground of freedom.

    The federal government, with the aid of the States, has completely destroyed Americans playground of freedom. The only way the people can restore and maintain their playground of freedom is to keep government out of it and I know the only “constitutional” way to do that is to vote to not reelect “Lawmakers” that enact legislation allowing government police and aliens to invade it.

    Will the People restore the constitutional Republic and playground of freedom? It looks very doubtful to me because the People are divided on and by political issues. Think about that one a moment – what political issue do the People have the Right and Power so resolve? I think honoring, or not, the Oath of Office is the only political issue the people have the Right and Power to resolve and that only with the ballot box. How much more power do a free people need over government than hiring (or firing by not rehiring) Lawmakers every two years?

    Allan I may be slow but I eventually get there. In reading back over the post I can see that you like playing the devils advocate. I have no disagreement with that as there will surely be many that will not embrace states rights. They prefer the comfort and security of having a big brother even though it is a false security. I am not the one to be a spokesman for this movement. I am not a Constitutional scholar. A good wordsmith such as yourself would have me chasing my tail to prove my point with no problem. I do not believe we are in disagreement on the importance and benefits of the Tenth Amendment to the states. I am a registered Independant and know that way too much is made of one party or another by the media. The liberals are actually out front of the conservatives in promoting individual rights but the media will portray this as a right wing movement. It is up to those of us who support this movement to get the message out correctly and not let the media decide how it is portrayed. I will leave those finer details to people such as yourself and others on this board who can make the message coherent and bipartisian.

    From the bottom of my heart I thank you and the Tenth Amendment advocates for your efforts in citizenship. I support the “People” making any effort attempting to correct government but do not necessarily support their method. And I reserve the Right to disagree, I try to encourage disagreement, let’s talk about it.

    In the beginning and the end the maintenance of America, the Constitutional Republic, rests squarely on the shoulders of the People, Americans and no one else or any other entity.

    It is perfectly clear to me, and history is my witness, that the Republic cannot be maintained by relying on political parties, professional politicians, political rhetoric, and arguing political issues, legislation (legalese), Supreme Court decisions, and gossip.

    Americans, the People, must enforce the Constitution on government and whatever he said she said does not change the Constitution, no matter who s/he is.

    It’s a tough cruel world and getting meaner daily and Americans can’t do anything to correct the world but they sure can correct their government, clean their own house.

    I try to express the “constitutional” power Americans have to correct government and try to deflate nonsense on that subject.

    For my part and I encourage all supporters to do the same, I will visit as many political news boards and blogs as possible and direct people to this site so they may become informed. As Americans we will have disagreements but the one thing we should all agree on is the wisdom of our founders in making our land a Republic. Governed by laws and not people. Until now the task seemed too overwhelming for an individual to have any meaningful impact. The states rights movement breaks it down into managable bites. Each state has only their legislators to convince and if they cannot be convinced then it provides opportunity for new blood. This will also mean supporting some idea’s many are against such as gay marriage and abortion. This is where the media as been able to divide us by making these type things the issue while ignoring the Constitution. They are in control of the battleground whether we like it or not. It is a pandora’s box to debate interpertation of our rights. The tenants of the Constitution and Bill of Rights are stated quite clearly and on these things we must agree and then we will be united.

    You said exactly my position – the People must, are obligated, to enforce the law of the Constitution on all USA governments, Local, State, and Federal.

    Political issues are like carrots dangling in front of a donkey citizenry. If you know any political issue the People can resolve and have the power to resolve please post the issue and power?

    I know of but one, the Oath of Office.

    Gay marriage – My opinion on the constitutionality of that matter is it is none of my, or governments, business. Licensing a “contract” (marriage between people) by government is unconstitutional; reference Article I, Section 10. Licensing a Right “infringes” that Right and therefore unconstitutional.

    The People allow unconstitutional legislation to remain on the books (enforceable by government when stupefying Jurors) by reelecting Lawmakers that enact such laws.

    I take exception with the term “the American people”, as if Americans were somehow monolithic. There is no issue on which all, perhaps even most, Americans agree. Saying “the American people” is misleading, if not outright deceptive.

    Mr. Lytle, The “Amnerican People” is a graduated term for “We the People”. We the people are not constrained by any principals other than our founding documents. These documents make The American People subject to the rule of law and that makes us united in that we all live in a Republic. If my explanation is unclear to you perhaps Allan or another poster with better word skills can express the concept more clearly.

    Maybe it depends on what you think an American is. What common ground do Americans have in their freedom of speech (arguing/debate/disagreement/protests, marches/petitions/Courts)?

    If there is nothing common to the USA Citizenry then there are no Americans. Americans common ground is the Duty in Citizenship. Do you know what that Duty is?

    Article I, Section 2.of the Constitution and Amendments 5, 6, and 7, of the Bill of Rights explains “Americans” Duty in Citizenship which is Americans common ground.

    Have you considered who is obligated to protect you from government abuse under the color of law? Check out FIJA
