When I hear the term “conservative” in a modern political context, I can’t help but wonder – what exactly do they want to conserve?
One would assume a conservative in the United States would seek to “conserve” the principles upon which the Republic was founded. That would lead me to further assume that a conservative would stand up as the fiercest defender of the Constitution, not as a living breathing document, but as the instrument the framers intended. I would assume a conservative would adhere tenaciously the ideals of limited government, enumerated powers and the Tenth Amendment admonition that all authority not delegated to the federal government remains with the states and the people.
But you know what they say about assume. It makes an ass out of you and me.
Conservatives talk a good game, preaching limited government, individual responsibility, blah, blah blah. But all of the talk floats off into the air like a comic strip thought bubble when the self-described conservative finds an issue he thinks government power can “fix.” How many “conservatives” voted for TARP? How many voted for the Patriot Act? How many supported NDAA? How many voted to expand Medicare with a prescription drug program? How many show any real inclination to phase out Social Security?
I could go on.
And on.
Modern conservatives show more interest in “conserving” the status quo of about 30 years ago than they do “conserving” the constitutional foundation of the United States. The conservative movement in America reminds me of a dinghy trailing a big sailboat. The larger vessel leads the way, cutting a new path through the water. The dingy perpetually follows behind, but always progresses forward as well, getting further and further away from the point of origin. In the meantime, a sailor stands in the dinghy chastising the captain of the sailboat for moving forward, seemingly oblivious to the fact that they he continues to push ahead as well. He rails against the direction of the ship, all the while gradually accepting his current location – the very spot that was so abhorrent just a short time ago.
The Supreme Court’s criticism of the Environmental Protection Agency earlier this week illustrates the point. At issue, the heavy-handed enforcement of rules after the feds told an Idaho couple they can’t challenge an order declaring their future home site a “protected wetlands.”
The “conservative” members of the Court railed against the EPA. And they made some good points.
According to an AP story, “Justice Antonin Scalia assailed the ‘high-handedness’ of the environmental agency when dealing with private property, and Justice Samuel Alito described some of the EPA’s actions as ‘outrageous,’ arguing that most people would say ‘this kind of thing can’t happen in the United States.’”
The justices seemed to take issue with the way the feds enforce the wetland rules, failing to give the property owner a fair shake in challenging EPA rulings.
“You think maybe there is a little drainage problem in part of your lot, so you start to build the house and then you get an order from the EPA which says: ‘You have filled in wetlands, so you can’t build your house; remove the fill, put in all kinds of plants; and now you have to let us on your premises whenever we want to,’” Alito said. “You have to turn over to us all sorts of documents, and for every day that you don’t do all this you are accumulating a potential fine of $75,000. And by the way, there is no way you can go to court to challenge our determination that this is a wetlands until such time as we choose to sue you.”
Chief Justice John Roberts expressed frustration with EPA fines and their chilling effect.
“Because of the administrative compliance order, you’re really never going to be put to the test, because most land owners aren’t going to say, ‘I’m going to risk the $37,000 a day,” he said. “All EPA has to do is make whatever finding it wants, and realize that in 99 percent of the cases, it’s never going to be put to the test.”
But notice that these conservative justices never challenge the very existence of the EPA regulations. They never make an issue out of the fact that no constitutional enumeration exists granting the federal government power to declare private property wholly within a state a “wetland,” off limits to development. And clearly, no such power exists. Regulation of lands within a state fall under what James Madison called the “objects which, in the ordinary course of affairs, concern the lives, liberties and properties of the people, and the internal order, improvement and prosperity of the State,” objects intended to remain under state control.
Nope, these conservatives accept the notion of EPA regulations as a given. They just don’t seem to like the way the feds implement them. Honestly, I’m really not even clear on what they hope to preserve. Perhaps due process?
Here we see the analogy at work. The ship long ago left the port of constitutional fidelity and the protective harbor consisting of a division of power between the state and federal governments. The sovereignty of the states and the people fades away into an archaic concept written on yellowing parchment. The various federal agencies long ago took on a life of their own, and most Americans, even “conservatives,” accept their place in our lives as a given. With few exceptions, we no longer fight their existence, just the way they go about business.
The ship plunges forward and the conservatives on the dinghy beg, “Please, slow down.”
But it never seems to occur to them they might want to start yelling, “Stop! Go back!!”

Ya back in the day, but since the mind set is strictly set on control and power and authority of every single aspect of life can we see the true acts, the true results of actions done. Presidents on the take, Congressmen on the take, Judges on the take all for some wild idea of authority, only this wild idea is made up in their own minds because the rest of us know we only hold our own authority over our selves.
Conservatism used to mean to conserve controls, conserve on rules and regulations and laws. Today it is abundance, abundance and abundances in all categories like the flood gates to the kingdom opened up and said watch this.
Back when we had independence rather than the dominance, liberty was a part of that independence and life was allowed to show its self , allowed to be heard and understood because the Republic was alive, it had been decided by so many and it was relevant.
Today the lack of respect for ourselves is in direct relation to the lack of understanding of ourselves. We have by some been diverted from the truths in an attempt by our enemies who were never more mad about their loss to Independence. To watch people independent of them, free thinkers, informed deciders, creating goods and services without restrictions.
Through all that time our enemy has persisted with no end in sight, an idea to rule created, a defiant decision to carry out such acts and all that is left if the display of results left from their wake. The real tool used to do this act of tyranny was secrecy, a tool so old, so brutal, so ignorant it is lifeless in its effects.
In this revolution will be brought forth the acts of evaluation and validation into all acts to verify authenticity of the decision made as well those who have decided such tragic acts against all fellow life, with careless distortions, and ruthlessness actions beyond all conciseness. No act shall go un-evaluated and all secrets revealed because in all honesty no life has a thing to hide. ignorance has managed itself upon us and now it is time for the informed to rise in abundance and deliver the final blow to those forces of evil with no compassion for life at all.

I consider myself a conservative Mr.Maharrey You have aptly described me in your opening paragraphs. What your article clearly points out is the divisiveness of ‘labels’ and why their application is no longer useful in identifying classes of people. Hence we have labels like ‘right wing extremist’ or ‘pro-choice advocate’ often misapplied. They are used to subdue the beliefs and arguments of those who have strong feelings on different subjects. They are used to categorically dismiss those whose viewpoints are tangentially opposed to our own. The point is simply, class labels are nearly useless without the context of the subject in question applied to those whom we label. New labels such as ‘preservationist’, ‘constitutionalist’ or ‘restorationist’ quickly lose their import when wrongfully applied out of context.
@scott adie I agree Scott. Language evolves. It is also often coopted, especially in the political world. The main goal of the politician is to get elected, so they apply terms to themselves in order to appeal to a specific voting block. They politician may or may not actually believe the tenants described by the given label, and she may not mean it in the same sense as the people in the group she is trying to appeal to define it. But the group merely hears the label, accepts it within the context they understand it and assume the politician is “one of us.” That was really my point in writing this piece, to try to get people not to blindly accept a person as “one of us” based on labeling, but instead examine the record and actual words of the individual.

Very well stated Mike and yes the language does evolve but lets not leave out the language is manipulated as well. History more than anything presents this to us. Many times expressions were only meant for a mere few versus a many.
Acceptance of the statement 9/10th the law these days without investigation because assumption has taken precedence as a habit of laziness instead of a habit to investigate using effort.

This is filled with great examples of how far gone some are in this country because they have no idea Independence is Liberty and not using this as the basis for choice is devastation. Recognize, you have been shown.

I am a visitor here. I don’t understand one thing. Do you not agree with people that view our national resources (like our rivers, for instance) are shared by the whole of our population? (Or in the case of rivers, many times they supply drinking water to several states).

National resources are what owned, or cared for? Sure some think they own them but show me they do.
Next what would this have to do with conserving in a Government, to have more regulation? But more regulation is not a conservative act, so who are the acting, who are the authority and who are the deciding factors in all choice.
You need to dig for answers, you need to find why they mean what they do. If I give you the answers do you learn them or assume them because I say? Use some of your precious skills given as life my friend, dig.

I hope all you Ron Paul followers take the time and check this out. Your great “defender of the US Constitution” has voted 4 of 5 times that the Patriot Act has come to the floor of the House to keep it in place. The Patriot Act was the biggest grab at our rights since the end of the Civil War. How can someone like Ron Paul justify his voting record on the Patriot Act? He doesn’t get my support on that alone.
OK Jack. I doubt your source, but I’ll give you some time to back it up. Now answer this: Who among the current candidates for president voted against patriot act more often than Ron Paul? Nobody? That’s what I thought.

Ah just a note about Romney not voting for the NDAA or the patriot act. HE WASN’T ELECTED TO THE HOUSE OR THE SENATE AND SAYS HE SUPPORTS IT AND IT SHOULD STAY IN PLACE. Did you watch any of the debates Frankie???
I was shocked to read Jack’s statement about Ron Paul supposedly voting for the Patriot Act multiple times! I don’t know where on earth that info came from! Ron Paul is very outspoken on the wickedness of the Patriot Act. I went to search Ron Paul’s entire voting record on everything regarding the Patriot Act and I couldn’t find one single time he voted to uphold anything about the Patriot Act! Not One!
