If Thomas Jefferson could come back and visit the United States for a day, would he recognize the government his wisdom and wordsmithing helped create?
He would likely be confused, or outraged, by the overreaching power of the federal government. He would bristle at the coercive use of matching funding and unfunded federal mandates to make the states submit to the will of the federal system.
Federal mandates and power grabs have been happening for years, but gaining momentum is a national movement to demand the federal government adhere to the designs of our forefathers and enforce the 10th Amendment. That amendment says powers not delegated to the federal government are reserved to the states or the people.
Recently, I co-authored a resolution urging the federal government to end all state mandates beyond the scope of powers outlined by that 10th Amendment. We were joined by 19 other Republicans and six Democrats as co-authors. It passed in the Senate overwhelmingly, 44-3.
Similar resolutions have been introduced in over 30 states. Many leaders in those states have recognized the checks and balances our forefathers built into the U.S. government have eroded to dangerous levels.
Early American statesman Alexander Hamilton said, “The people will always take care to preserve the constitutional equilibrium between the federal and state governments.†This balance formed a double security for the people. If one encroached on their rights, they could find a powerful protection in the other.
Our founding fathers said the federal government should be concerned with war, treaty and commerce between the states and abroad — period. Everything else — roads, education, agriculture, etc. — is a state responsibility.
Programs such as the far-reaching “No Child Left Behind†and massive federal stimulus plans with as many strings as dollars both disrupt the balance built in our system of government.
This issue is not an attack on the Obama Administration. This is not a Democrat-versus-Republican issue. This issue is about the legitimacy of authority wielded by the federal government.
Our founding fathers knew what they were setting up. Conflict between the state and federal systems was by design. Jefferson teamed with another future president and statesman, James Madison, to write this resolution for Kentucky and Virginia: “The several states composing the United States of America are not united on the principle of unlimited submission to their General Government …â€
Powers of the federal government are, as the Constitution clearly outlines, “delegated.†They are not inherent. This arrangement made the federal government an agent of sorts for the states, authorizing it to act on their behalf in certain ways — not vice-versa.
If our U.S. Constitution is to be anything other than a dusty document we honor in a museum, we need to keep those principles alive in our hearts and minds. While he might be dismayed at how out-of-balance our government currently is, I think Thomas Jefferson would also be pleased to see resolutions passed in so many states protesting federal intrusion. After all, it was Jefferson who said, “Dissent is the highest form of patriotism.â€

The same issue of the Washington Post also happened to carry a story about the Obama administration's reversal of the Bush policy of "preemption." Preemption, in this case, does not refer to the "Bush Doctrine" in international affairs, but rather a quiet and largely unremarked upon policy by which the Federal government presumptively and preemptively overturned State-based laws in areas of interest to private business interests. According to one person quoted in the article, "'It's environmental law, it's drug law, it's mortgage law, it's a whole host of areas where the Bush administration was really aggressive about using regulatory action to clear state and local laws that businesses and corporations didn't like,' said Doug Kendall, president of the Constitutional Accountability Center." Federal regulation was regularly, even promiscuously used to overturn legitimate State legislation in areas where private business demanded uniformity for the sake of efficiency, profit, and economies of scale. Assistant Vermont Attorney General Elliot Burg said NAFTA and other trade agreements have opened up a path for international companies that want to circumvent state laws they don't like.

Since Indiana is the last of nine states endorsing the Liberty Amendment, It is likely that here are a few legislators in the State Legislature who will remember it. That is only 25 years ago. As for the Tenth Amendment, I and all who work on the Liberty Amendment are behind it and for everything it can do to stop the Socialist SteamRoller. But we are concerned that it can only –STOP—the movement and not correct everything the Federal Government has grabbed in its operations over the years.
The Liberty Amendment started in the 40s and fifties was designed to restore the Constitution to its full force and effectiveness, and restore our federal government to the constitutionally limited representative republican form of government. The Federal Government would loose all the unconstitutional powers it had grabbed in 150years, and taxes for its operation would be reduced appropriately. Calling for a constitutional convention is like seeking to burn trash on a dry day in a forest when the wind is blowing. You can’t control what happens. I hope you will re-think this.
What makes you think we can better control what happens by use of the other method? Who do you think the ultimate arbiters of the constitution are in any event?
The trick is, that everyone gets separated - either by religion, color of the skin, viewpoint, "class" as in blue collar, poor, rich - arrogance (I'm smarter than you are, and let me show you how much) - which you'll see in so many areas. I shudder to think of all the ways we as a human race are separated from each other.
Even in your own family, you'll have your "outcasts" or "black sheep" that nobody else in the family seems to want to deal with. Why is that? It's surely not from "human nature" although many would make you believe otherwise.

Buy your stuff from the store - do you grow anything? Do you know which plant you can eat and which you can't if left out in the open to your own survival? Do you know how long it takes to grow certain vegetables and fruits?

Nobody has the TIME to grow, not many people have the SPACE (especially in the city) to grow ANYTHING. Organic farmers, and the basic "down to earth farmer" not even organic farmers - all are being pushed down, drown out, and made to add toxins to their crops. Organic farmers are under heavy fire right now, because of the LACK of toxins - hey - big biz here wants you to spray this and that under FDA rules to keep the food "safe" for pete's sakes. Heck, now it's not even sprays, it's running all the food through radiated "light" to keep all of us safe from "food borne illnesses."
Safe my ass. It's all about the money the major drug corps need to sell their wares. do you know that the "light" they pass food through kills every nutrient in that food? We're over here in the "better lands" starving for nutrients that are being systematically being stripped out, while on the other side of the world - they just "don't get any."
And wow - wonder why we have such an "obesity" issue in this country. Unreal. All while our other brothers and sisters of the planet starve due to total lack of crop - ours is poisoned, or completely stripped of any nutrients that our bodies need to survive.

You can quote the "Constitution" all day. The crooked politician's in Washington are already bought and paid for. They don't represent us anymore. They won't act on our behalf, so there will be no positive results. There is only one way out of this mess, draw your own conclusion!
Yeah Ray, there's one way out - stop paying attention to D.C. Stop giving them your time, your energy, your votes - all of it. Working through or battling with Washington is a total waste and a failed strategy.
Get together with like-minded people in your own area. Lobby your local politicians, plan some non-violent resistance....these things will have effect when people have the courage to do them. Do you?

Please forgive me --- I have a few questions that perhaps do not relate directly with the EXCELLENT article above -- but thought this the best place to ask...
Since the day his signature counted for anything - (i.e. - becoming president) How many (and what) measures) has Pres. Obama actually signed, thus becoming law of the land?
Next question - How many companies does the central government actually own ... or at least a large stake in. Notice I said "the central government" owns - as we now know, since the TARP money that is now and will be repaid is not going to be returned to the lender - rather will be "used again" at the whim of Treasury for "other projects" -- the taxpayer has has joined countries like China - Japan, etc. (entities still stupid enough to loan it money)
Lastly, since becoming Pres. - how many "Czars" and the scope of their function have actually been appointed - Need only the one's who actually can have a real person's name attached to it (example - Czar Nicholas)

Ok, what about this...
What about everyone taking a look at the "DESIGN" of the "system" first off. and just WHO has done the designing over so many years, thousands in fact. Although I do totally support this movement to claim sovereignty for the state of Ohio and every other state, I seriously wonder what good it's going to do.
After much research and reading, here is how I see it. There are a group of people who control everything (including the federal reserve) who are involved in some really sick stuff. These people have interbred with each other - "royalty" - for thousands of years, and they currently pull all the puppet strings of all the "major players" around the world.
Including Obama. He is a "bloodline" to these "royal" families - and I personally knew he would be elected before he ever was. He's simply another "non citizen" that got into office because of his blood. Do some real research, and everything will become completely obvious, and all will make a whole lot better sense. Many people won't do this, and I'll probably get slammed right here - because not many will open their mind, and do some real research.
It would take me entirely too long to explain it all here, give names, etc - but everything is happening by design. The people behind all of this are what others call "the Illuminati." Do some searches on people like "Eustace Mullins" "David Icke" "Michael Tsarion" "Alex Jones" I could go on, but there are a LOT of people out there trying to spread the word of what's REALLY going on.
And it's not just the "united states" - it's worldwide.
Sadly, most politicians, police, military etc (at the lower levels) have absolutely no idea about what this "illuminati" thing is all about. Of course it is discredited, called a scam, a conspiracy and everything else - but I'll tell you what. If a person does enough looking into it - you'll really be surprised if your brain can handle it.
The politicians at the highest levels, the "skull and bones" , 33 degree Masons, and others - oh they KNOW what's going on. They are either too scared to face the Illuminati, because of the wrath (think assassination) - or they are directly involved as a "puppet".
The Illumined have their goals in mind, and they are playing their hands quite well. Better than "we the sheeple" by far. And the LAST thing we ever want to do, is come out with all our guns (yes we own them and know how to shoot them) - and start Riots. That's what they are planning, building, and waiting for. Like others have said here above - peaceful "resistance" and just saying NO to everything they throw at us is really the only way.
I have read that taxation is actually illegal, (horrors) and I will be looking more into that - but they have turned us into slaves working for THEM. WE pay. THEY spend, and HOARD the money. THINK ROYALTY here - because it's the bloodlines of the Illuminati that carry the power and the cash. They use and abuse the people of this entire earth, not just the United States.
I could go real deep into this, but the other folks I list here have already done that, been there, and are spreading the word for anyone who will wake up and listen. So, before you jump all over me as some kind of "fruitcake" - I suggest you do a lot more research and reading into it.

The feds have found a way to negate the 10th Amendment and a million 10th Amendment Resolutions will not change that fact.
The Tenth Amendment reserves every power not granted to the federal government to the States or the people. It only applies when the federal government attempts to exercise a power not granted by the Constitution. It cannot be invoked to prohibit the federal government from exercising a constitutional power. By using the federal judiciary to re-define and expand the scope of the federal power through the Commerce and General Welfare Clauses in the body of the Constitution, the Feds have established unlimited regulatory, taxing and spending power and the Tenth Amendment cannot be invoked to stop them because those two clauses are granted powers.

I was referring to the status of the amendment, not it's substance. I read the brief 4 posted sections of the amendment. it's definitely a multi prong approach to restoring States rights..
The Liberty Amendment although about fifty years old is further along in doing its thing than the Tenth Amendment. We gave up on getting it recognized in a liberal power-hungry Congress about forty years ago. It was the opinion of most that the persuasion would have to come from the States. The Website makes the effort in the Congress secondary. If it gets nowhere, the Tenth Amendment gets no where either. Maybe you better read it first before making comment on it . But get ready for about forty pages . The liberty Amendment is currently sitting in the Subcommittee on the Constitution, Civil Rights, and Civil Liberties. It is chaired by some of the most Liberal socialistic politicians DC has, Including jackson-Lee, Conyers, and Nadler as Chairman Just to name a few... It does have 6 republicans, not sure of their voting record, But they look like token opposition to the ten socialists.... The Liberty Amendment is as good as dead and buried.. This things not going anywhere.
Since Indiana is the last of nine states endorsing the Liberty Amendment, It is likely that here are a few legislators in the State Legislature who will remember it. That is only 25 years ago. As for the Tenth Amendment, I and all who work on the Liberty Amendment are behind it and for everything it can do to stop the Socialist SteamRoller. But we are concerned that it can only –STOP—the movement and not correct everything the Federal Government has grabbed in its operations over the years.
The Liberty Amendment started in the 40s and fifties was designed to restore the Constitution to its full force and effectiveness, and restore our federal government to the constitutionally limited representative republican form of government. The Federal Government would loose all the unconstitutional powers it had grabbed in 150years, and taxes for its operation would be reduced appropriately. P.S. About a Constitutional Convention, where there is an endorsement of thirty five states on a single same worded issue, the Convention will not be needed to force the Congress to submit it for ratification.

I wouldn't surprise me in the least if one day we who are like minded, end up being forced to meet in private homes in order to avoid violating a tolerance law, or a portion of a hate crimes law, or some American terrorist Law.. it's coming.. A hate crime is a crime that says you were thinking a particular thought at the time it was committed.. I can think of a million ways that could be applied to people who are driving to limit government.

I doubt Alexander Hamilton could have ever anticipated things like, Federal Tax returns, Federal student loans, affirmative action, FHA Home Loans. All of the things that the feds have enticed the average Joe to accept in return for federal control over their lives... The old guy would roll over in his grave if he knew what direction our country has taken.
One of the problems we are up against is that the government has made up its mind to ignore the law, and actually looks on those that call attention to it as "extremists." So, we who obey the law, pay taxes, go to church, support our families and mind our own business are extremists targetted by an outlaw government who flouts the law for terror and tyranny to be sure we don't step out of line or ask it to obey the law!

Although I am in support of all the 10th Amendment resolutions, at the end of the day, they really have no teeth. The states can only hope that the feds will sympathize with their situations. What it really all comes down to folks is who controls the printing of money, and you're going to need a Constitutional Convention in order to deal with that because the feds will never relinquish control of it. With all due respect and gratitude to State Senator Kruse for his Resolution, that his justification for protesting federal intrusion into reserved States' Rights rests mostly upon issues of unfunded mandates and the coercive nature of matching funds should greatly alarm us.
I doubt most American's fear and resistance to REAL ID had anything to do with unfunded mandates! We reject it in priciple because it is an unconstitutional intrusion into our private affairs! And, frankly, the idea of an all-power central government requiring a federal ID card scares the stuffings out of us! ONly a totalitarian minded government would dare propose something so pervasive! I noticed this with Charles Key's resolution in Oklahoma. In his interview (which is available at this site) he did not denounce it as unconstitutional, or an invasion of the American people's privacy, or a danger to our liberties, or any over-arching principle of the kind. He basically said it needed work to protect against ID theft at DMV portals.
What this tells me is that government officials, even part-time legislators at the State level, think like government agents and not like American people!!!! That's right. They think in terms of running the business of government more than the legalities and princples behind what they do. Scary stuff, folks!
I would rather see a Resolution that denounces REAL ID for what it is: a police state requirement foreign to the spirit of the American people and their system of government!
Unfunded mandates? Who gives a flip? Start thinking like people, not like government officials!

State governments better not merely wake up, but GET UP. All this whining about their broken budgets... You'd think even liberal states would see their deficits are caused by allowing D.C. to siphon wealth like a late-night gasoline thief with a fleet of SUVs. Western states can start by unlocking resources on "public lands" and ignoring the Department of the Interior!

Thank you for sponsoring your State's 10th Amendment Resolution. We the Poeple of the United States are indebted to you for helping to restore constitutional limitations upon the power of the federal government.
However, the main thrust of your appeal rests upon unfunded mandates and federal coersion through matching funds. While these are clear invasions of the powers reserved to the States in running the business of government, they are not issues of great urgency or moment in terms of our nation's liberties. Unfunded mandates and coersive matching funds will not make or break America in terms of liberty. More important by far are the invasions of a usurping federal judiciary that seek to "federalize" local issues of law and morals, depriving us of the right to teach our children, in our schools, funded by our taxes, what we deem best and right. More important by far is the consistent war waged by Washington DC and its agents and judiciary against the traditional values and beliefs that made the nation free and our communities safe.
How dare a usurping federal judiciary tell local school districts and parents that we cannot display the Ten Commandments on class room walls; how dare they presume to tell us we cannot display manger scenes at Christmas; how dare they presume to prohibit prayer at graduation commencement ceremonies; how dare they think they can close our class rooms to instruction in scientific creationism; how dare they endorse the utter folly of atheistic evolution as the only "scientific" theory to explain the universe, in all its beauty, order, and design! How dare they condemn millions of school children to state indoctrination that "life came from nothing, returns to nothing, and therefore means nothing." These are our children, not Caesar's and we have nowhere "delegated" to the federal government the right to intrude into their education. We say nothing about abortion or a multitude of other moral issues.

Virtually everything this national government gets involved in - from its wars and foreign policy to its restrictions on gun and property rights to its creation of so-called free speech zones, and so much more - are in direct violation to the constitution.
But you're right - focusing solely on unfunded mandates isn't the bottom line. But after all these years, I'm happy that people like Sen. Kruse are standing up against them. As long as people keep giving positive feedback to legislators for doing this - and courteously encouraging them to do more - then we'll make progress.

What makes you think we can better control what happens by use of the other method? Who do you think the ultimate arbiters of the constitution are in any event?
Terry - the ultimate arbiters are "we the people" When enough of us are sick and tired of this unconstitutional national government the world will be a different place. I don't think it's happening anytime soon, but people are certainly waking up to the idea.
That's probably why the feds are trying to grab up as much power as they can right now. The key is to peacefully resist at every turn possible. We see great movements in support of gun rights, rejecting real id, rejecting the drug war and more - all over the country and all across the political spectrum.
The federal government will not voluntarily give up its power, no matter how politely the states ask. It is up to the states to take it. Perhaps this is the reason the constitution guaranteed states the right to maintain a militia. Thomas Jefferson believed that states had to power to declare federal laws unconstitutional. Today, it is federal government that decides if the federal government is doing something unconstitutional. Sounds like foxes guarding hen houses.
Well, they're peacefully backing down from Real ID - and we'll have to make them peacefully back down from it's lesser replacement too.
Then, how about prohibition, gun rights and the rest? Without popular support, they really can't get away with all this forever.

Art. V, U.S. Constitution provides two methods of amendment. Let's repeal the 16th & 17th Amendments using the same method we used to get the other amendments passed.
Do not be seduced by Randy Barnett's pretended "Bill of Federalism". He pretends that his scheme would restore federalism; but actually, his scheme would legitimatize the usurpations by the legislative & judicial branches, and would grant sweeping new powers to those branches.PH
Resolutions are a safe vote because they carry no weight. Everyone is going to jump on board. I wonder just how many of the 44 who voted yes are willing to give up special interest money in exchange for a yes vote if it were a bill. How many are willing to risk their re election in return for actually voting to restore States rights?.
It seems that our elected leaders see the problem, but until we make holding public office less glamorous and less lucrative. This will be filed in the 'appease the malcontents', file.

I've read Jefferson's autobiography, his published letters and so forth, and "dismayed" is not the term, based on what I've read of him, that I would use to describe his reaction to the utterly imbalanced federal leviathon we've allowed to grow under our very noses.
