Can the President Kill You?

Can the president kill an American simply because the person is dangerous and his arrest would be impractical? Can the president be judge, jury and executioner of an American in a foreign country because he believes that would keep America safe? Can Congress authorize the president to do this?

Earlier this week, U.S. Attorney General Eric Holder attempted to justify presidential killing in a speech at Northwestern University law school. In it, he recognized the requirement of the Fifth Amendment for due process. He argued that the president may substitute the traditionally understood due process – a public jury trial – with the president’s own novel version of it; that would be a secret deliberation about killing. Without mentioning the name of the American the president recently ordered killed, Holder suggested that the president’s careful consideration of the case of New Mexico-born Anwar al-Awlaki constituted a substituted form of due process.

Holder argued that the act of reviewing al-Awlaki’s alleged crimes, what he was doing in Yemen and the imminent danger he posed provided al-Awlaki with a substituted form of due process. He did not mention how this substitution applied to al-Awlaki’s 16-year-old son and a family friend, who were also executed by CIA drones. And he did not address the utter absence of any support in the Constitution or Supreme Court case law for his novel theory.

The Fifth Amendment to the Constitution states that the government may not take the life, liberty or property of any person without due process. Due process has numerous components, too numerous to address here, but the essence of it is “substantive fairness” and a “settled fair procedure.” Under due process, when the government wants your life, liberty or property, the government must show that it is entitled to what it seeks by articulating the law it says you have violated and then proving its case in public to a neutral jury. And you may enjoy all the constitutional protections to defend yourself. Without the requirement of due process, nothing would prevent the government from taking anything it coveted or killing anyone – American or foreign – it hated or feared.

The killing of al-Awlaki and the others was without any due process whatsoever, and that should terrify all Americans. The federal government has not claimed the lawful power to kill Americans without due process since the Civil War; even then, the power to kill was claimed only in actual combat. Al-Awlaki and his son were killed while they were driving in a car in the desert. The Supreme Court has consistently ruled that the Constitution applies in war and in peace. Even the Nazi soldiers and sailors who were arrested in Amagansett, N.Y., and in Ponte Vedra Beach, Fla., during World War II were entitled to a trial.

The legal authority in which Holder claimed to find support was the Authorization for the Use of Military Force (AUMF), which was enacted by Congress in the days following 9/11. That statute permits the president to use force to repel those who planned and plotted 9/11 and who continue to plan and plot the use of terror tactics to assault the United States. Holder argued in his speech that arresting al-Awlaki – who has never been indicted or otherwise charged with a crime but who is believed to have encouraged terrorist attacks in the U.S. – would have been impractical, that killing him was the only option available to prevent him from committing more harm, and that Congress must have contemplated that when it enacted the AUMF.

Even if Holder is correct – that Congress contemplated presidential killing of Americans without due process when it enacted the AUMF – such a delegation of power is not Congress’ to give. Congress is governed by the same Constitution that restrains the president. It can no more authorize the president to avoid due process than it can authorize him to extend his term in office beyond four years.

Instead of presenting evidence of al-Awlaki’s alleged crimes to a grand jury and seeking an indictment and an arrest and a trial, the president presented the evidence to a small group of unnamed advisers, and then he secretly decided that al-Awlaki was such an imminent threat to America 10,000 miles away that he had to be killed. This is logic more worthy of Joseph Stalin than Thomas Jefferson. It effectively says that the president is above the Constitution and the rule of law, and that he can reject his oath to uphold both.

If the president can kill an American in Yemen, can he do so in Peoria? Even the British king, from whose tyrannical grasp the American colonists seceded, did not claim such powers. And we fought a Revolution against him.

    @RonPaul_2012 the president should not have the legal power to kill with out due process, nor can war be declared with out congressional ok.

    Mr. Napolitano sure made this a clear picture and what it does is clearly represent a corrupt corporate Government intent on its own agenda outside our Constitution. This line is very clearly crossed and now it shall become our duty to regroup. I suggest a very in depth understanding of the Declaration of Independence as the guide book on this activity and then an understanding how this may be brought about. Its not magic that changes this course, it is good knowledge, good choices and a strong foundation to build on. Its time we get really motivated on the activities of our future. Its not too late because we are still alive to decide and as long as this is the case it can be what ever we make it. There is not a visual concept that was not put here by choice folks and you really don’t need to be a scientist to review this statement. All creations are done so by choice, its what we put into our choices that allows the concept to take place. If you have a clear picture a clear visual will take place, when it is not clear the results will not be clear either.
     
    Our Government has fully over stepped its bounds and is not in compliance with our Constitution rules and for this reason we must reconstruct and new one. The Declaration of INDEPENDENCE is very clear on this statement and the Constitution merely supports this concept entirely.
     
    It is up to us to get this and make the right choices to support our idea of this country which is? A Republic folks.

    Let me see if I have this straight. Government passes a law granting government  the authority to order an American killed without following constitutional mandates, but if that same American were to mention, while drinking at a bar, that a government official should be killed for usurpations of power under the Constitution,  government claims the authority under the Constitution to investigate and prosecute the individual for violations of the law.
     
    Looks like Joseph Stalin’s minions are alive and well and running the federal government.

    The recent uganda video that went viral is an indication. Already obabma has sent troops there without even telling Congress why. He also is asking the military for more black soldiers in the special forces division. This the way dictators are made……he wins approval for getting rid of this thug and all the millions that have seen this video appauld and elect him. Unless they are taught the truth that the president of Uganda is just as bad as Kony in the video and OIL has been discovered. Also, Kony was run off in 2005 and is most likely already dead.

That infiltraton of these innocent identities by that which is subtley and heinously corrupt does not in any way make guilty that which is innocent. America and all that which is truely American is inherently and naturaly innocent of the nature of that which it is. Domestic tranquility being a complete and peaceful (tranquil) absence of angry behaviour is a great basis for a truely moral, ethical, innocent nation and nations citizen government….inherently innocent.

    Decisions are everywhere, some good and some very bad but consistently across the board does Government make far more poor choice over good choice. It is truly the Financiers dream state of corrupt by making it look RICH and powerful with DEBT. Power and authority corrupts and all who decide to be this power and this authority have become this by choice.
    The idea is broadcast this way;
     
    LOOK at me I am powerful (totally corrupt) and limits Life.
     
    Versus
     
    LOOK at this achievement and how is sustains our communities as Republics and promotes Life.
     
    One is irrational decisions and the other very rational choice making and since not one idea comes to be with such a choice it is good to look at what we put into such choices.
     
    The Declaration of Independence is rational choice making.
     
    The Declaration of Rule by Finance has no rationality and is the wrong choice. Deliberately making this choice is what Rule wants to corrupt you. Because they also know not one things takes place without choice and they together are focused on their agenda, you in their debt.
     
    How many of us who choose good choice are focused on our Declaration of Independence as a viable choice with a Constitution that supports Liberty in Republics.
     
    Again poor choices are made every day, maybe we should look at our own decisions and change these to fit the desired idea or continue the effects of very poor choices.

      This is only pure proof A Republic did not exist and that Democracy was promoted and the difference is PUBLIC meeting of discussion and displays of proof which is a Republic way of life. The informed then make informed choice in the voting station. Democracy is a perverted word by its definitions and one definition almost always gets mixed with the other definition intentionally.
       
      Though these military men from the war helped to stand up because they were sure of what they were fighting for, the preservation of their way of life as A Republic with Liberty fully included, when liberty is gone so is the Republic way of life. But the public way is community meetings in discussion of its sustaining practices, other wise it becomes politicians and their way of made up false authority over such a Public. Many of these instances and very valuable lessons are to evaluate and discuss for future choices and viability.

    A quick lesson in democracy;.. 3 chickens, 2 rabbits, 5 birds,7 humans, 4 worms and 11 wolves decided to meet and have a democratic vote (majority rules) on whats next for breakfast. At the next meeting for lunch the worms were not there and the chickens looked somewhat 4 worms fatter. Again at the next meeting they were missing, for the vote, the 2 rabbits. Then the same at the next meeting…there were no voting chickens and the worms were noticed to be flavoring the chicken meat. 5 birds were next noticed to be missing then 7 humans. The wolves began devouring one another.
      Moral of story?….Get your stinking democracy out of our Republic.
