How the New Indefinite Detention Provisions can be used on Americans
Congress just passed, and the President just signed, a bill that gives legal authority to the President to kidnap and perpetually imprison persons, including American citizens, without the benefit of due process.
Members of Congress, in the days leading up to the vote, tried to assure their constituents that they have nothing to fear — that the bill doesn’t apply to Americans.
Some were lying. Most were deceived.
Now, I don’t want to imply that Barack Obama plans to sweep up every one of his critics (or even a select few) because of statements they’ve uttered publicly. That is overstatement. The law doesn’t permit that. But consider the following scenario…
You object to the way the Federal Leviathan State is run. You gather, every other Tuesday, with others who share your values. We’ll call your fictional group the Constitution League (CL).
One night, a new fellow shows up. He’s frustrated and outspoken. He complains that the time for meetings is over. Something must be done — something that will “get their attention.” You’re uncomfortable with his remarks but unsure how to respond.
You hope he never returns, and he doesn’t.
What you don’t know, until months later, is that one of our CL colleagues, the chapter Vice President, followed the vocal man out to the parking lot. The two exchanged email addresses and phone numbers. Then, your local VP reached out to a third man, a member of a CL chapter in the nearest big city. The three met regularly. They plotted and executed their own terrorist plot on a U.S. Government facility.
Now, your group meeting was the place they met. The Vice President used his CL email account. CL is all over the news. CL is now, for all intents and purposes, a terrorist group.
And you? Well, you’ve donated to the terrorist organization. You’ve participated in its meetings. The night this angry man walked in, you didn’t call the authorities.
* Can the President have the military come and arrest you? Yes!
* Can he (or she) send you to a military tribunal for trial or just hold you indefinitely in a military facility, without charges? Yes!
Even the bill co-sponsor, Senator McCain, appears to agree with this assessment. Senator Rand Paul asked John McCain, on the Senate floor, “…under the provisions, would it be possible that an American citizen could be declared an ‘enemy combatant’ and sent to Guantanamo Bay, and detained indefinitely?” McCain responded, “I think that as long as that individual, NO MATTER WHO THEY ARE, if they POSE A THREAT to the security of the United States of America, should not be allowed to continue the threat.” {Emphasis Added}
Wait a minute. Wasn’t there a provision in this bill that exempted Americans?
Despite what your Congressional office may have told you (if you called during the debate over this bill) the answer to that question is an emphatic NO!
The relevant sections of the bill are 1021 and 1022.
* Section 1021 asserts the President’s authority to arrest suspected (not convicted) terrorists and gives him the option to choose whether or not they even get a trial, and if so, what kind of trial.
* Section 1022 requires that a certain class of terrorist get no trial. Instead they must be held in military prisons, for as long as this President, or any future President desires.
SECTION 1021
Section 1021 is very expansive in its reach. It “includ[es] any person who has committed a belligerent act or has directly supported such hostilities in aid of such enemy forces.”
* Who is “any person?”
* What is a “belligerent act?”
* What is “direct support?”
One could be safe in assuming these words mean whatever a creatively-minded prosecutor, a flexible judge, and an ignorant jury define them to mean — EXCEPT THAT, UNDER THIS ACT, ONE MIGHT NEVER GET AS FAR AS A COURT HEARING.
These terms will be defined by the bureaucrats in power.
They could be used against political opponents.
1021 has NO exceptions. There’s not even a hint of an exception. Remember, that section gave the President the authority to arrest you and a set of options on how you were to be handled. These choices are completely divorced from the 4th, 5th, 6th, and 8th Amendments, as well as the Treason provisions of Article III. The President’s new alternatives are…
1. Detention without trial by the military
2. Trial by a military commission
3. Trial by some other court of the President’s choosing
4. Shipping you off to a foreign jurisdiction (info here)
SECTION 1022
1022 is a REQUIREMENT — a binding mandate upon the President. President Obama threatened to veto the bill, but only because he feared 1022 would restrict his power too much. http://gawker.com/5866210/jon-stewart-bashes-obama-for-backing-indefinite-detention-bill
This section is for your fellow CL members/plotters. Whereas, you got snatched up for “support” or “aid” to the plot, they actually carried out an attack, or as the section itself indicates…
“…participated in the course of planning or carrying out an attack or attempted attack against the United States or its coalition partners.”
Section 1022 requires the President to go with option #1 above — the other three options are off the table. In other words, no trial, either in a civilian court or military tribunal.
In the final version of the bill, after a public storm started to erupt, the title of the section was changed to indicate that it only applied to “foreign al-Qaeda terrorists.” However, titles are not normally considered part of the law but merely summary descriptions to the reader of a bill.
But this title is especially IRONIC, because it’s this section that includes the so-called exemption for American citizens. Why would you need to exempt American citizens from a section of law that applies to “foreign al-Qaeda terrorists?”
The answer is because the section applies to any kind of “terrorist,” domestic or foreign, no matter what the title says.
And here’s the so-called exemption, with the key word highlighted…
The REQUIREMENT to detain a person in military custody under this section does not extend to citizens of the United States.
That means that military custody, without a trial, is mandated by law, but that the President, at his discretion or by written policy, may issue a waiver on the basis that a person is an American citizen.
If this provision was a true safeguard for American citizens, then the line would’ve been written like this…
Military custody of citizens of the United States is still prohibited under this act.
See the difference? It’s a requirement that can be waived at discretion, as opposed to a prohibition.

Now, do you realize Congress has given the Federal State the power to use military detention on its own citizens? And that they’ve made it possible to wage a war on peaceful activists, if they can just incite someone in your group to attempt something violent?
Don’t worry. It’s not like the FBI is busy infiltrating meetings, entrapping some dullard into a plot, equipping and financing his efforts, and then claiming credit for stopping another terrorist attack! Oh wait, that’s happened about 40 times since 9/11.
Thus, to complete our story, the angry man who showed up at the CL meeting might’ve work for the FBI. And he duped two idiots in your group, who put you and your fellow members in legal jeopardy.
This new law is that serious. President Obama has claimed he won’t use this power. All that needs to happen now is a provocative incident. Then, all bets are off. Since these nearly unlimited, un-constitutional powers are now law, this President, or a future one, will be able to kidnap and disappear Americans. It could very easily be open season for the police state.

You can help eliminate indefinite detention and restore due process for US citizens by contacting your representatives and urging them to support the bill H.R.3676.
H.R.3676 is a one page bill that in clear, unambiguous language amends the detainee provisions of the National Defense Authorization Act for Fiscal Year 2012 to specifically state that United States citizens may not be detained against their will without all the rights of due process afforded to citizens in a court ordained or established by or under Article III of the Constitution of the United States. http://www.opencongress.org/bill/112-h3676/show
@alea_iacta_est But doesn’t that leave the determination of what “due process” is to a judge or a bureaucrat? How about a bill that says the NDAA is repealed?
Or – maybe – if they don’t fix this – which I don’t expect – we just stand up and nullify the whole damn thing on a state level?
@Michael Boldin What it does is help ensure that the discussion and determination of what has been decided to be “due process” is done in the light where we all can see. And if we don’t like what we see, we can take action to change it. The problem with these “indefinite detention” powers is that the determination of one’s guilt happens behind closed doors and without recourse for the accused.
The point of my original post was to provide anyone who cares to take action (beyond bitching in online comments) a means to affect change and address this particular assault on our civil rights.
Also, you may want to take some time to research what else is in the NDAA 2012 bill before you start calling for a repeal in its entirety. It’s a massive bill that does other things besides horribly infringe on our civil rights.

This is assuming that a) I haven’t done so already and b) after doing so, I’d likely not want to repeal the whole thing.
Both of those are totally wrong. But – that doesn’t mean we can’t consider ourselves on the same side on the important issue of due process!

The constitutional authority on which this bill rests is the power of Congress to “provide for the common defense,” “raise and support armies,” and “provide and maintain a navy,” as enumerated in Article I, Section 8 of the United States Constitution.”

WOW, since I am life, a producing American and an individual I do not fall under such provisions. My acts in support of Life and Liberty which is to restrict such an offensive statement does not adhere to said false statement for I am my own authority as presented as life and documented in the Declaration of Independence. The constitutional adherence restricts said Government from making such claims because it would become defined as tyranny or acts against said life. The person or persons defined can only be defined by said tyrants which by said act is tyranny itself.
By my foundation the Declaration of Independence and my liberty defined by my Constitution limits what said congress may do or make up. This may be true but who is standing defiance? Why are you, why not me? Because we lack something, we lack certainty that out countrymen will back us. Our foundation is floundering in this country and because it is so is the Constitution. It can only be upheld by those certain of its content for which it stands and allows the standing itself. This not done by interpretation but rather by knowledge of the facts with such certainties.
In order to grow a pair the Declaration of Independence would need a full understanding of its very application by the many and not just 3. Choice makes all things happen and the more choice in any pending direction the more chance it takes place. This is only because of the opposing choice to control and destroy. Defiance is the standing up against this with full knowledge of you as defined in The Declaration of Independence the foundation, the rock, the source of all choice in the direction of such a Republic, otherwise it is 51% percent of a corrupt Congress in some wild idea of democracy.
Be informed, inform others, know what delivery truly means, prepare, decide and lets put the idiots out of business for good so true value may show itself for what it really is.

The Constitution has a treason provision that even stipulates that these criminals can be executed for their treason once found guilty. Now that is a rosy picture, is it not? Let’s only hope that our military takes their oath to protect the country from “domestic enemies” seriously and handles these criminals before we the people are forced to do so.

What about the principle that an illegally constituted law is NOT a law, is not valid?
This NDAA is a Mobius strip, a closed twisted loop. Usually, a party aggrieved by a law is the one with standing to challenge it before a court, submitting it to judicial scrutiny. But under the NDAA, the aggreived party is secreted away in the dark of night, and cannot petition the court. So the law stands without challenge. Congress passed it, president signed it, courts can’t look at it without a complaint, and those with standing to complain would be under military detention. It’s perfectly demonic.
So, with all these inmates running the asylum, WHO IS THERE TO DEFEND THE CONSTITUTION? (Actually, is there anything even LEFT of the Constitution that these traitors haven’t illegally legislated away or opined negatively in rogue courts in just a handful of years? The first huge assault I can name is Kelo versus New London in 2005, stripping private property rights.)
As for the U.S. military, stats say 75% would not follow an illegal order (or some such wording). Do you really think the government would risk using the Constitutionally loyal military, then? Don’t forget that Napolitano put veterans are on the potential terrorist list, too. No, a rogue government would use rogue armed forces, paid mercenaries. Can anyone say Black Water (or whatever their name is now)?

Last I understood was the people who choose to live as A Republic defended their constitution to live as one and where are we with all our uncertainties and our confidence?
Lingering, hopeful, dreaming but lack the most important piece, acting. This is in no uncertain terms and is a basic lack of understanding on our part of the very basics of such a Republic. What is the foundation of this country? Do you live by it, why not?
You can only defend what you believe in because you know clearly what it is, otherwise it is obscure and uncertain and lacks full confidence. Study and fully know how to apply the Declaration of independence, it is your Foundation to live as A Republic should you choose and the Constitution is Liberty when adhered to, to be free from such corrupt Government should you decide this to be the case.

God gave me life, gave me will, gave me choice and determining skills, I simply decided to use that which I was given in support of what I know I am. There is no confusion, it is clear as we are. The un-recognition of this by most is all I really fear because as I have observed those who respect life share respect with all such life and this is an act which can be seen. Pretending this is not the case is not an option I will consider, I am life and I know I am of life and I recognize all life around me, I recognize the acts in support or against, I arrive at the truths by such acts. Its not what another says to me but is willing to show me because of my very own willingness to show. Actually there is no reason this could not take place because by doing the acts that uphold the constitution we would be in adherence. But first comes the clear understanding of the Constitution as well the foundation of this country and this is what is missing. Solid footing comes from knowing what is the right thing. Well, thats a good idea. say, why havent we heard anything more about Texas State. Georgia State, and a couple of others? What about California State? If this is true: The Constitution was formed, among other purposes, to make the People’s liberties secure – secure not only against foreign attack but from oppression by the American People’s own government. Our forefathers set specific limits upon the national government and upon the States, and reserved to the People all powers that they did not grant. The Ninth Amendment declares: “The enumeration in the Constitution, of certain rights, shall not be construed to deny or disparage others retained by the people.”
If this is also true: The wording of the Presidential Oath was already established in the Constitution in Article II, Section 1, Clause 10. The requirement for all other Federal and State Civil officers to give their solemn and binding Oath is established in Article VI, Section 1, Clause 4. They are BOUND by their Oath to support the Constitution, and should they abrogate their Oath by their acts or inaction, are subject to charges of impeachment and censure.
If these are the Oath’s sworn words concerning the US Constitution: The three branches of our government, the military, all law enforcement, the heads of the States, all federal employees are required to take an Oath to support and defend the Constitution and not an individual leader, ruler, office, or entity. Once given, the Oath is binding for life, unless renounced, refused, and abjured. It does not cease upon the occasions of leaving office or of discharge.
President: I do solemnly swear (or affirm) that I will faithfully execute the Office of President of the United States, and will to the best of my ability, preserve, protect and defend the Constitution of the United States.
@KansasBright It seems like the 9th amendment is one of the most ignored of all time. They should have made it clear that the citizens are in charge. It should have been something like a sovereign citizen amendment. Stating that citizens are sovereign in the way States are, and should only have to obey the Constitutions above them along with laws protecting others, and their property from physical harm. I think there should have been a property rights amendment as well stating that once a person pays off their land they shouldn’t have to pay rent on it or have it taken away for not paying or under eminent domain. Then again it probably wouldn’t matter because the Feds, and even the States ignore the 10th amendment.

The highest law of the land the Constitution is the restriction of powers of people within a Government. It whole heartedly supports Liberty as defined in the Declaration of Independence. Its an action of support to restrict these 3 branches from stepping outside said restrictions. I am not clear on what you are saying. If you are saying that the restrictions are on the each specific branch (positions within the branch). That the people who decide they want the office/position in whichever branch do so with an understanding that those restrictions apply and that they Must follow them; then I agree with you.
They were free to choose to take the office or position, they were not free to arbitrarily do away with the job requirements that they took an Oath to uphold and “supposedly” (again their choice if they did not) knew the job requirements.
Example: X goes camping. Decides to pay and use a campsite where there are port-a-pottys available for use. The campsite requires if you use the campsites there you use those facilities. Choices are still there, but one can get you arrested and fined.

It’s extremely deceptive, and diabolical how our government was taken over. I disagree, they chose to do this no matter the outcome. They make choices just like the rest of us do. Temptation is around all of us every day. They would be less likely to make those choices if we were doing OUR job and holding them accountable, never allow the votes to be between the “two evils” (as in “lesser of two evils” getting the vote) by demanding higher standards of OUR representatives, etc. It was their choice, now it is up to us to choose to let them get away with destroying our nation with no or very little fight, or we hold them accountable for their actions.

I do not believe terrorists should be brought to the United States and granted the same rights and privileges as American criminal defendants. Terrorists should be kept at Guantanamo Bay and prosecuted through the military commissions established by Congress under the terms circumscribed by the United States Supreme Court. Trying to hold civilian trials in the United States for terrorists does nothing more than place Americans at risk, while providing terrorists with a platform from which to spew their hate-filled ideology and recruit like-minded fanatics around the world to join them in jihad. We must not forget that we are a nation at war against ruthless killers who wear no uniforms and deliberately target innocent civilians. Treating their war crimes as ordinary criminal acts and trying these killers in a civilian court under the U.S. Constitution would simply be reverting to a dangerous, pre-9/11 mentality.
As you may know, Congress passed the Military Commissions Acts of 2006 and 2009, making a powerful statement that U.S. civilian courts are not the appropriate venue to bring terrorists to justice. The military commissions were specifically designed to prevent damaging disclosures and to protect classified information, as well as sensitive sources and methods. We know that these military commissions have a long history in our Republic—dating back from the Revolutionary War and the Civil War, to World War II. They are the most appropriate forum for terrorists to be tried for their crimes. Furthermore, in its 2004 opinion Hamdi v. Rumsfeld, the Supreme Court recognized that, in accordance with longstanding principles under the law of war, an individual determined to be an enemy combatant, including a U.S. citizen, can be detained by the Executive Branch until the end of the military campaign against al Qaeda and affiliated terrorist groups.
Therefore, I supported amendments to the Senate version of the National Defense Authorization Act for Fiscal Year 2012 (FY 2012 NDAA; S. 1867) regarding terrorist detention practices. It is important to note that these provisions do not extend any new legal authorities to detain U.S. citizens, rather they clarify existing authorities as utilized by the President and recognized by the Supreme Court. Section 1021 of the final version of the FY 2012 NDAA (H.R. 1540) would reaffirm the President’s indefinite detention authority under the 2001 Authorization for Use of Military Force (P.L. 107—40). Additionally, Section 1022 would require military detention for a certain subset of unprivileged enemy belligerents—members of al Qaeda and affiliated entities—pending their disposition under the law of war. By its own terms, Section 1022 explicitly exempts U.S. citizens from the requirement for military detention. These provisions were originally included in the FY 2012 NDAA that was unanimously reported out of the Senate Armed Services Committee (SASC), and they remain in the final version of the FY12 NDAA that was passed by the House of Representatives and the Senate. H.R. 1540 has now been transmitted to the President to be signed into law.

Thank you for contacting me regarding certain provisions of H.R. 1540, the fiscal year 2012 National Defense Authorization Act (NDAA). I welcome your thoughts and comments.
It has been suggested in some press accounts and commentary that certain provisions in this bill would allow the President to detain American citizens within the United States indefinitely if the President brands them as a terrorist. That is simply not accurate.
On December 15, 2011, Congress passed H.R. 1540, which contains two sections (Sections 1031 and 1032) that address the detention of suspected terrorists. Over the past decade, the Bush and Obama Administrations have detained members of terrorist organizations, both at home and abroad, in order to protect our country and our people. The federal courts have affirmed the legality, general and specific, of such detentions. Congress added Sections 1031 and 1032 to the NDAA in order to codify the limits of detention authority.
Section 1031 establishes guidelines to allow U.S. Armed Forces to detain “covered persons” captured during hostilities as unprivileged enemy combatants, under the laws of war. A “covered person” is now defined in federal law as a person who planned, authorized, committed, or aided the terrorist attacks of September 11, 2001. Nothing in this section authorizes U.S. Armed Forces to capture and detain U.S. citizens for any other reason.
Section 1032 requires U.S. Armed Forces to hold in custody as an unprivileged enemy combatant any person who is a member or part of al Qaeda or associated forces, and who participated in planning or carrying out an attack or attempted attack against the United States or its coalition partners. This section clearly states that this requirement does not extend to citizens of the United States.
These two sections of the NDAA have been the subjects of some controversy. Americans are right to be concerned and vigilant about potential threats to our civil liberties. Please be assured that I and other Members of Congress reviewed Sections 1031 and 1032 of the NDAA very carefully and consulted with respected legal experts before giving bipartisan approval.
Should related detainee provisions come for consideration before the full Senate, you may be certain I will keep your views in mind.
