What if the Constitution No Longer Applied?

by Andrew Napolitano

What if the whole purpose of the Constitution was to limit the government? What if Congress’ enumerated powers in the Constitution no longer limited Congress, but were actually used as justification to extend Congress’ authority over every realm of human life?

What if the president, meant to be an equal to Congress, has become a democratically elected, term-limited monarch? What if the president assumed everything he did was legal, just because he’s the president? What if he could interrupt your regularly scheduled radio and TV programming for a special message from him? What if he could declare war on his own? What if he could read your emails and texts without a search warrant? What if he could kill you without warning?

What if the rights and principles guaranteed in the Constitution have been so distorted in the past 200 years as to be unrecognizable by the Founders? What if the states were mere provinces of a totally nationalized and fully centralized government? What if the Constitution was amended stealthily, not by constitutional amendments duly passed by the states, but by the constant and persistent expansion of the federal government’s role in our lives? What if the federal government decided whether its own powers were proper and constitutional?

What if you needed a license from the government to speak, to assemble or to protest the government? What if the right to keep and bear arms only applied to the government? What if posse comitatus – the law that prohibits our military from our streets – were no longer in effect? What if the government considered the military an adequate dispenser of domestic law enforcement? What if cops looked and acted like troops and you couldn’t distinguish the military from the police? What if federal agents could write their own search warrants in defiance of the Constitution? What if the government could decide when you weren’t entitled to a jury trial?

What if the government could take your property whenever it wanted it? What if the government could continue prosecuting you until it got the verdict it wanted? What if the government could force you to testify against yourself simply by labeling you a domestic terrorist? What if the government could torture you until you said what the government wanted to hear? What if people running for president actually supported torture? What if the government tortured your children to get to you? What if the government could send you to your death and your innocence meant nothing so long as the government’s procedures were followed? What if America’s prison population, the largest in the world, was the result of a cruel and unusual way for a country to be free? What if half the prison population never harmed anyone but themselves?

What if the people had no rights except those the government chose to let them have? What if the states had no rights except to do as the federal government commanded? What if our elected officials didn’t really live among us, but all instead had their hearts and their homes in Washington, D.C.? What if the government could strip you of your rights because of where your mother was when you were born? What if the income tax was unconstitutional? What if the states were convinced to give up their representation in Congress? What if the government tried to ban you from using a substance older than the government itself? What if voting didn’t mean anything anymore because both political parties stand for Big Government?

Learn the truth from Judge Nap

What if the government could write any law, regulate any behavior and tax any event, the Constitution be damned? What if the government was the reason we don’t have a Constitution anymore? What if you could love your country but hate what the government has done to it? What if sometimes to love your country, you had to alter or abolish the government?

What if Jefferson was right? What if that government is best which governs least? What if I’m right? What if the government is wrong? What if it is dangerous to be right when the government is wrong? What if it is better to perish fighting for freedom than to live as a slave? What if freedom’s greatest hour of danger is now?

One right is equal to every right. One liberty is the same as freedom itself. If you cede even one to another's permission, the form of your slavery will be at their discretion.

Between bogus legislation by Congress, such as the ObamaCare BS, Executive Orders anytime a president doesn't want to use Congressional process, and a Supreme Court that owes their favors and position to a particular party, the Constitution is now just a piece of really old paper that nobody in power pays any attention to. It's no longer even taught in public school and the average Jane and Joe on the street has no real idea what their true rights are let alone what the limitations are on the three branches that run our government. We need a Constitutionalist in the White House and both houses of Congress!!

Just FYI, if the constitution no longer applies, then neither Congress, the president, or the judiciary have a right to exist since it is the same document that created them all.

Then they aren't amendments and the only force they have is that which is ruled by either coercion or fear and certainly not by force of law.

Being right when the government is wrong isn't a big deal so long as you shut up and remain a docile and compliant citizen.

Yes, "what if"? This is a great way to make people think about reality. Allow them to reach the obvious conclusion.

The Constitution died long ago due to the expansion of the 4th Branch/The Bureaucratic State. Arguably, the precedent for such over-reaching was the 1787 Con-Con itself which betrayed the Revolution and original Republic.

Bob we all wish we would not be forced to such a choice but we have been before and there is no reason to believe it will not happen again.

Every time I see the words of Thomas Jefferson, I don’t just see and hear the wisdom of what he has seen, I totally get what he has realized was bestowed upon life, a capacity to recognize ignorance and the ability to stand firmly in defiance of it in all honesty to ourselves.

This can only come from being informed and far from ignorant and knowing exactly why certain choices come into play. Knowing the principals of humanity by such acts that fully support it are what when defined?

It is so simple for one mind in life to make up some unauthorized authority as you have seen it in many settings and not just Government. Making this determination does not authorize but you will not convince the fully decided.

All force resides in choice and all genuine force resides by the principals of Humanity in a chosen direction and that direction is fully in support of such a life. Those touting differences to such an objective or accomplishment simply lie to themselves and hope and prey for acceptance rather than determined defiance. Determined defiance will usually end up in brutality because it is the determined up against opposite determined.

There is no such thing as winners in brutality for respect for self becomes lost in the acts against the very source of all of us as LIFE. It is important to get what life truly is and what it is truly capable of. This can only be done in support of it and not acts up against it because determination is all we have to move forward with and counter determinism only counters all we are and the movement forward.

Just ask yourself when moving forward in a determined direction and you meet an opposing determination what takes place? Why is that?

On July 6th, 1775, the Continental Congress adopted: A Declaration by the Representatives of the United Colonies of North-America, Now Met in Congress at Philadelphia, Setting Forth the Causes and Necessity of Their Taking Up Arms [http://avalon.law.yale.edu/18th_century/arms.asp].

The following was written by Thomas Jefferson:

“We are reduced to the alternative of chusing an unconditional submission to the tyranny of irritated ministers, or resistance by force.—The latter is our choice—We have counted the cost of this contest, and find nothing so dreadful as voluntary slavery.—Honour, justice, and humanity, forbid us tamely to surrender that freedom which we received from our gallant ancestors, and which our innocent posterity have a right to receive from us. We cannot endure the infamy and guilt of resigning succeeding generations to that wretchedness which inevitably awaits them, if we basely entail hereditary bondage upon them."

"With hearts fortified with these animating reflections, we most solemnly, before God and the world, declare, that, exerting the utmost energy of those powers, which our beneficent Creator hath graciously bestowed upon us, the arms we have been compelled by our enemies to assume, we will, in defiance of every hazard, with unabating firmness and perseverence, employ for the preservation of our liberties; being with one mind resolved to die freemen rather than to live slaves.”

What if modern Americans were forced to make this choice?

What if I was life and I made no choices based upon such a fact? What if everything you say is true Judge Napolitano?

What if results is all we needed to verify these facts?

What if the only reason we are here today is because we did not read and fully understand the Declaration of Independence and apply it daily in our lives?

What if embarrassment of our own stupidity could actually awaken us?

What if I just sit down and never said a word, how would I provoke one thought among you?

Thank you Mr. Andrew P. Napolitano for being a true provoker.
