		<description><![CDATA[The enumeration of certain rights (such as the right of habeas corpus, or a speedy trial among many) that are guaranteed in the Constitution, and bill of rights, would deny others by a common rule of interperetation referred to frequently in the Federalist as an affirmative in one instance means a negative in all others not listed (simply put the enumeration of some rights without the ninth amendment  could automatically be construed to mean the ones listed are the only rights protected).  As referred to in the article, the founders really viewed rights and powers as 2 sides of the same coin, thus the limitation of contruction of limits to rights, limits the broadness of the powers enumerated to the Feds.]]></description>

It starts out by saying whatever rights in the constitution can not be construed to deny rights already retained by the people.   1)  I thought the constitution never had any rights declared for the people 2)  How can rights deny other rights?  3)  I thought they only had powers.
