Not a Penny More!

An Open Letter to Speaker John Boehner From Judge Andrew P. Napolitano

Dear Mr. Speaker,

When the Founders at the Constitutional Convention in 1787 created the House of Representatives, it was fashioned to act as the voice of the people within the institutional checks and balances of the Federal Government. That’s why the entire House faces reelection every 2 years. That’s why Constitutionally, you don’t have to even be a member of Congress to serve as speaker. And that’s why the Constitution allows for thousands of members of the House for our current population.

It is the people’s house, and the people spoke last November. They cried out against a government completely out of control.

After President Bush grew the U.S. debt by $7 trillion dollars in 8 years in office, and President Obama added $4 Trillion in just 2 years in office, the people cried out against big-government policies that are sabotaging the economy and taking over our lives.

And because they cried out, you are no longer just John Boehner from Ohio. You are now the second in line to succeed to the presidency. You are the Speaker of the House of Representatives.

Mr. Speaker, the House of Representatives has just 8 working days left before the August 2nd debt ceiling deadline, and by wide margins in whatever way the question is asked, Americans do not want to see the debt ceiling raised. They’re sick and tired of paying interest on borrowed money; money borrowed in their name.

The Federal Government borrows so much money from so many sources, Mr. Speaker, that no-one knows for sure just how much it owes to its lenders. It already appears that it has exceeded the legal limit set by the congress at $14.294 trillion, and they actually at this moment in time are closer to $14.5 trillion.

The White House is putting intense pressure on you and on Congress to raise that limit. The President’s apologists have even suggested invoking the 14th amendment to bypass the will of Congress and borrow money without legal authority.

Given the way the White House has run roughshod over your House in the matter of the “not-war” in Libya that our military is still “not” engaged in, the word of the President’s lawyers that there is no presidential power in the 14th amendment to borrow money on his own can hardly be trusted.

This is a president who does not regard the Constitution as a limit on the exercise of governmental power. But the President can only get away with violating the Constitution, Mr. Speaker, if you let him do so.

If you stand up for the will of the people, you will restrain him. This is the moment of truth for the Congress, Mr. Speaker. The scare-mongers and the chicken-littles in DC will tell you that the sky will come tumbling down if the debt ceiling isn’t raised, even though your colleagues, Senator Pat Toomey and Rep. Tom McClintock, have introduced legislation that would prevent the United States from defaulting on its debt obligations.

I have two words for you, Mr. Speaker. Stop it. That’s right, just stop it. For too long our government has spent beyond its means and in our names, sinking us and generations as yet unborn into deeper and deeper debt. And you, Mr. Speaker, can stop it.

The President stands with the big-business, big-banks, big-government complex, and against the American people. He’s even prepared to defy the laws of economics. But the American people are not ignorant as he thinks they are, and you know that.

Mr. Speaker, you have the opportunity to do something that no standard bearer of small government has ever been able to do in our modern era; get the government to live within its means. You can do it by standing firm with your colleagues in the Congress who are leading the call for change. You can stop it. You can force the Federal Government to make the difficult decisions to bring itself within its means and begin to loosen the chains of debt that have been foisted on our country by a centuries worth of progressive big-government architects.

End it this summer, Mr. Speaker. Stop it. Tell the President, “not a penny more.” Stand up for the American people, bring government within its means, and begin the restoration of our republic.

If you do this Mr. Speaker, if you restrain the federal beast, you will become one of history’s great champions and heroes of freedom.

If you don’t, we’ll all go through this again the next time a president wants to spend beyond the government’s means and chain us all down to more debt.

Mr. Speaker, don’t let us down.

Don't forget that the agency debt is off-budget and NOT included in the ~$14.5T public debt (held in treasuries). It is currently ~80% of the treasury debt. If we added it all the liabilities together it would be $21.6T. If you think that number is bad, just wait - if the BBA passes, nearly spending will become agency debt giving a new meaning to the term "knowing where all of the bodies are buried." Sorry, but the BBA isn't the kind of financial salvation people think it is. We would be much better off with a clarification of the commerce clause, fixing Article III and IV providing an official process by which states can overturn SCOTUS. That will solve our spending a debt problems without messing with the statists' arbitrary solution to big gov't that we know won't last very long.

The election process that put those (mostly) stooges in office is rigged from the outset via ownership of all venues of public discourse, publishing, highly politicized movies and TV, and a left-and-right-sided Janus-faced gantlet ensuring nobody but stooges of the elites has a chance for even becoming a candidate in most every district and definitely at the state level. Didn't Rick Perry and a Republican leader in Texas recently side with the TSA? We've had it unless we take back the electoral process at the precinct level and throw out the operatives. I went to a Tea Party rally in New Haven last year, where somebody not from Ct took the mike and attempted to work the crowd up in favor of this bogus War on Terror and the neocon agenda. This guy was more like a union goon than any Republican I've ever known. We need to identify these bums in both parties and show them and anyone they're promoting the door. As an aside about the coming police state, my town's dog warden was just telling me this morning that when he innocently went up on the railroad tracks to retrieve a woman's dog killed up there, an MTA cop came running at him, pointing his drawn gun at the dog warden, who was dressed in police uniform, and held him while he called in the "incident" to some federal clearing center. He told the dog warden that he should arrest him, but let him go. Now, if these federalized goons do that to a cop in uniform, think of what's coming for the rest of us.

This is NOT a spending problem this is a looting and theft problem. All the bail-outs and quantitative easing is nothing more than a ponsi scheme. It's flat out fraud.

I trust the Judge Napolitano knows what he says and the Speaker is the right person for the job. The judge does not mention Boehner by name, but Boehner is in the Title of this post. The problem I have is that Boehner has ALREADY betrayed the people TWICE by negotiating with the imposter/usurper that occupies a certain oval office. Is Boehner fit for the job? I sure hope Boehner grows a spine and stands up to the administration. The Speaker MAY be the person who SHOULD do the job, but will he?

The Judge has said it all with this letter.

I will wait and see, although I have no expectation anymore that the Speaker or any other member of the government, save the few who are there that already are trying, will act on it.

The ONLY "living and breathing document", is the Declaration Of Independence. In it, the citizens of the US are enjoined to replace a government that has become out of control and stands in the way of life, liberty and the pursuit of happiness.

We threw off the yoke of the King of England for those reasons. We now face the same situation, and must remove the government in Washington D.C.

I no longer see any other way, after a lifetime of trying via the electoral and political methods of the Constitution I believe in and support with all my heart and soul. The functions of the Constitution no longer exist in this country.

We did it once and we must do it again.

Of course, there is one other way to cut the power of these 'civil servants' and that would be for more to join the 50% who don't pay taxes already. All apparently legitimately, or the IRS would be clogging the court system. It may take some real patriotism to do what is needed to legitimately join the ranks who have said 'not with our resources'.

How many would it take to stanch the flow of 'power' to spend? The assets are wrecked. Just the cashflow to go.

The runaway spending of the Federal government is unsustainable, but there's no incentive for them to stop as long as it's not their money that they're spending, they're not accountable for spending it, and what they're spending it on ultimately comes down to buying the favor of the few whose influence actually matters inside the Beltway.

Yes, standing firm and saying "Not one red cent more" is going to hurt. But it won't hurt as much as letting the debt rise another three, or five, or ten trillion, until we hit the point where we CANNOT pay it. (I have seen sound, reasoned arguments that we have already passed that point; that paying off the debt of the US Government already requires more dollars than actually exist.)

We're warned that not raising the debt cap may cause a crash. But raising the debt cap will only put off that crash; and the longer we put it off, the bigger and nastier it's going to be, and the longer it's going to last, and the worse it's going to hurt all of us — except for the tiny elite who have spent the last thirty years accumulating something like 60% of all the wealth in the US. They're going to be just fine.

When the current white house occupants are "fumigated out of the bldg"..& a RESPONSIBLE CONSTITUTIONALLY BASED PRESIDENT IS THERE...then "DA JUDGE" better be lined up to take a MEANINGFUL SEAT ON THE SUPREME COURT BENCH...Me thInks the two newest "unqualified" choices by Obama...ie Sodomayor & Kagan..if in ANY WAY POSSIBLE should be impeached,..removed..given early retirement..etc..etc. so as to get the SUPREME COURT into a MORE "CONSTITUTIONALLY BASED" FORM OF JUDICIAL ACTIONS FOR WHICH IT WAS ORIGINALLY INTENDED..what say you??

Q: Why won't the federal government/treasury of the People of the United States print and issue it's own debt-free money again? Didn't a certain American president -- for the good of the United States & its People & the Constitution -- effect such a change just less than five decades ago? What happened?

I believe the certain American president you are referring to, was assassinated for his efforts and the United States Notes his executive order authorized were almost immediately taken out of circulation. Within 5 months of the assassin no additional 1958 Silver certificates were issued and they were also subsequently removed from circulation.
