"Wickard is worse than the situation in old England because it regulates what one can do with one’s own property, not the king’s land nor even public lands, but one’s own land."

“Rightful liberty is unobstructed action according to our will within limits drawn around us by the equal rights of others. I do not add 'within the limits of the law' because law is often but the tyrant's will, and always so when it violates the rights of the individual.” Thomas Jefferson
 <a href="http://faculty.cua.edu/pennington/law508/JeffersonRights.htm" rel="nofollow">http://faculty.cua.edu/pennington/law508/Jefferso...</a>

Wrongful liberty is unobstructed action according to the tyrant's will with no limits, or within limits drawn around the tyrant by the unequal (inferior) rights of others. Tyranny (from the point of view of the tyrant) is unobstructed action according to the tyrant’s will with no limits, or within limits drawn around the tyrant by the unequal (inferior) rights of others; i.e.: the tyrant possesses wrongful liberty.

"And if liberty is to be attributable of the real man and not of the scarecrow invented by the individualistic Liberalism, then Fascism is for liberty. It is the only kind of liberty that is serious - the liberty of the State." Benito Mussolini

Tyranny (from the point of view of a serf) is obstructed action according to the tyrant's will within limits drawn around us by the unequal (superior) rights of the tyrant and his favorites. Wickard is tyranny because it obstructs my action (obstruction of liberty) according to the tyrant's will within limits drawn around me by the superior rights of the tyrant and his favorites. Wickard violates the right of the individual to rightful liberty.

It’s even worse than you thought.America’s history of regulating foods is based on legislation from a statute from Virginia in 1873. That’s 138 years ago.

“The tradition of food regulation established in England.” Id. at 35; see also id. at 43 (citing a Virginia statute passed in 1873, that ‘made it an offense . . . [to] knowingly, sell, supply, or bring to be manufactured . . . milk from which any cream has been taken; or milk commonly known as skimmed milk’)”

Even worse, Americans have no right to choose what they consume nor any right to bodily and physical health. According to the FDA we have no actual right to choose what we eat. In an excerpt from the briefing to the supreme court case: Farm-To-Consumer Legal Defense Fund vs. the United States Department of Health and Human Services the FDA implicitly stated the American public’s “claim to a fundamental privacy interest in obtaining ‘foods of their own choice’ for themselves and their families is without merit.” In other words, we don’t actually have the right to choose what we eat. Furthermore, the American public has no generalized right to bodily or physical health. The plaintiffs assertion of a “fundamental right to their own bodily and physical health, which includes what foods they do and do not choose to consume for themselves and their families” the FDA declared is “unavailing because plaintiffs do not have a fundamental right to obtain any food they wish.”

Read the briefing for yourself, see pages 25-26 in particular: <a href="http://www.ftcldf.org/litigation/ey100426--ds_mtd_memo_in_support.pdf" rel="nofollow">http://www.ftcldf.org/litigation/ey100426--ds_mtd...</a>

I disagree on your optimism. Morrison/Lopez were very narrow, fact-specific victories for federalism and freedom that unfortunately solidified the New Deal era's approach to the Commerce Clause.
