I have to politely disagree with Derek. I've heard that point before and it doesn't ring true. The states did create the federal government but you're pretty close in saying it's a matter of symantics. But the symantic difference is in the language used in the 18th century, not today. As always, when interpreting something written long ago (like the Constitution) you have to determine what the authors meant. So, did the founding generation believe the states were agreeing to the Constitution and ratifying it, or did they believe the people of the states were doing so? To answer that question I'd point you to the words of Thomas Jefferson who, in writing the Kentucy Resolution of 1798 clearly explained that the states were the creators of the "central" government. It is symantics in that the founding generation equated the states as 'the people" in a way we normally don't today. So I believe it is incorrect to say the states did not create the federation. The founding fathers seem to have felt otherwise.

We should get rid of the lower courts completely that way the federal government is forced to bring their case before a state court. This will give the citizen of that state an advantage and perhaps that particular court in that jurisdiciton will find thelaw null and void.

What a great article! I only have one small disagreement and it's a rather technical, if not semantic difference. The federal government certainly didn't create the states, but neither did the state governments create the federal government. The PEOPLE of the several states created the federal government when they ratified it in their separate ratifying conventions, which bypassed their state legislatures. Some have also made the mistake of thinking that the federal government was created by the American people in aggregate. This is also a false idea, since the Constitution was not ratified by the American people as one great mass. Rob Natelson's article "It's the People's Right" and the video made with it really clarify this point.
