Thatâ€™s correct and perhaps true since 1787, and They get away with it simply because the Citizenry allows Them to get away with unconstitutionality. 

The Citizenryâ€™s mistake in thinking is simply thinking government is supposed to enforce the Law (Constitution) on government; which amounts to the fox guarding the hen house. It is the Citizenry that is constitutionally obligated to enforce the Constitution on government.
