You're absolutely correct that the Judiciary shouldn't be "legislating from the bench" Their role is to rule as to whether cases before them fit into the Constitution or not. But this has absolutely <strong>NO </strong>bearing on whether or not the executive should follow the constitution or not. If one were to follow your reasoning, we'd end up with a run away train. Mr. Bush and his pet Coconut Gonzalas could care less about the Constitution and Bill of RIghts. They have their own agenda. And their agenda is called Treason. They need to be tried for such. If we don't stop them now, then we and our children and their children will suffer. If you don't think what I am saying is true, then look to Germany and the former USSR and see how they are still paying for their inactions against such criminals. It is called Checks and Balances.
