The ACLU is nuts to claim the Feds have never prosecuted anyone in compliance with State law. Heck, it even went to the Supreme Court, United States of America v Oakland Cannabis Buyers Cooperative decided by the SCOTUS in 2001. Oakland even went so far as to deputize the OCBC's principals and filed an amicus curiae supporting them as agents of the city. They tried basically the same legal theory when they prosecuted Ed Rosenthal in 2004(?).

The claim that no one out of compliance with State law is prosecuted is simply a way to keep the public off of the back of the Feds for prosecuting people supplying medicine to the sick. Now the only proof needed that they're out of compliance is a Federal indictment. Yes, I'm cynical and bitter. That doesn't make my assertions incorrect. Let's see what the IRS decides in the current investigation of Harborside Health in Oakland and San Jose. If they're not in compliance with State law then nobody is. IIRC that was the only dispensary which I ever visited which had ADA compliant rest rooms.

This gives me hope! Because no matter the outcome of the upcoming US Supreme Court ruling on obamacare, states STILL don't have to obey. It is un-Constitutional no matter how any court rules on it. And that's what the state of Washington is saying regarding marijuana. If Washington state can thumb their nose at the federal government AND its highest court when it comes to marijuana, then so can other states regarding obamacare!

Gregoire has already "implicated" several state employees when the state department of revenue sent out letters and collected sales tax from dispensaries already operating. Her argument is moot and she needs to realize that if she veto's this bill, she will no longer have the support of state Democrats come election time.
