		<description><![CDATA[Good article.  The only problem is that Woods doesn&#039;t seem to realize that the principal/agent analogy doesn&#039;t really work.  In the legal world, if an agency contract is the subject of dispute between the parties, the dispute will be resolved as described in the agreement and, if there is no dispute resolution provision, it will be resolved in a court of competent jurisdiction.  It will not be resolved by the principal(s) unilaterally. 
 
Had the States created a dispute resolution clause in the US Constitution, we could follow it.  However, they didn&#039;t and we have no court of COMPETENT jurisdiction because the federal courts are a branch of the agent that is a party to the &#039;contract&#039; (the federal government) and so have a conflict of interest that disqualifies them from hearing the matter. 
 
Similarly, the State courts have a conflict.  So, we have no obvious way to resolve these disputes. 
 
This is why I&#039;ve said repeatedly here that it was a mistake for the Founders to fail to specifically address this issue.  As soon as Marbury was decided, there should have been a Constitutional amendment that addressed the issue. ]]></description>
