This whole discussion is about promoting a true federal system. You can see how far we have moved toward the consolidation side of the liberty scale in America when a principle like nullification, which promotes true federalism is seen as kooky by those who, like Barnett, have actively supported the restoration of federalism in the past. Barnett also thinks that calling for the repeal of the 17th Amendment is too kooky as well even though Eugene Hickok writes that it would be "difficult to overstate the impact of the Seventeenth Amendment on Congress and on federalism (Why States?, 61)." I suppose those pushing for restoration of constitutional principles will have to wait until radical becomes respectable. But will it be too late by then?

I think the best opportunity to advance the nullification cause is when the Supremes probably rule against the suits by the states against Obamacare. The may be a few state legislatures with sort of a backbone who will do the right thing and avoid state bankruptcy.

Derek, we've already seen someone qausi debate Mr. Woods in Interview With a Zombie. Unfortunately, Mr. Woods almost had his brain eaten in that little episode. I'm not sure he'd be too excited to repeat that. :-)

In all seriousness, after having read Mr. Wood's and Gutzman's Who Killed the Constitution, I'll be buying this newest work as soon as payday hits again (only four days left). I'm sure I'll share it's information as often as I share what I learned in Who Killed the Constitution.

I recognized most of the arguments against nullification as being very poor before I read Tom's book. Now I'm anxious to hear someone actually engage him in a fair debate with equal time given to each side.
