The following is based off a speech given at the Palm Desert Tax Day Tea Party on April 15, 2010

There are a few core beliefs that guide me in everything I do as the founder of the Tenth Amendment Center

  • Rights are not “granted” to us by the government – they are ours by our very nature, by our birthright.
  • ALL just political authority is derived from the people – and government exists solely with our consent!
  • We the people of the several states created the federal government – not the other way around!
  • The Tenth Amendment defines the total scope of federal power as being that which has been delegated by the people to the federal government in the Constitution – and nothing more.
  • The People of each State have the sole and exclusive right and power to govern themselves in all areas not delegated to their government.
  • A Government without limits is a tyranny!
  • When Congress enacts laws and regulations that are not made in Pursuance of the powers enumerated in the Constitution, the People are not bound to obey them.

These seven items are about sovereignty, which is something we hear about quite a bit lately – but few really understand. Sovereignty is defined as “final authority.” All through history, this final authority was in the hands of just one or two people – a king, a queen, or even just a small cabal of elites at the top of the food chain.

But the founders and ratifiers gave us something unique in history – a first, really. They created a system where the average people – you and I – held final authority. We the people are sovereign. We the people hold final authority. We the people are in charge. And, they the government work for us!

The Tenth Amendment codifies in law this principle of popular sovereignty – that “We the People” of the several states created the federal government to be our agent for certain, enumerated purposes – and nothing more. But unfortunately, that’s not how things have been working, and very little that the government does is actually authorized by the constitution. And, this is a problem that didn’t just start in January 2009 – it’s been going on a long, long time.

Question – What do we do about it?

  • Do we call and email our representatives in Congress and ask them to limit their own power?
  • Do we march on D.C. and demand that the government limit its own power?
  • Do we sue them in their own courts and ask their judges to limit their power?
  • Do we vote the bums out in 2010, or 2012 – and ask new politicians to limit their own power?

Thomas Jefferson and James Madison both warned us that if the federal government ever became the sole and exclusive arbiter of the extent of its own powers – that power would endlessly grow…regardless of elections, separation of powers, courts, or other vaunted parts of our system.

Guess what – they were right. For a hundred years, we the people have been suing, and marching, and lobbying, and voting the bums out – but yet…year in and year out, government continues to grow and your liberty continues to diminish – and it doesn’t matter who is the president, or what political party controls congress – the growth of power in the federal government never stops.

The problem we face today is not about personalities or political parties – it’s about power. Until we address the absolute fact that the federal government has too much power, things will never change.

Question – What do we do about it?

Jefferson and Madison gave us the answer. In response to the unconstitutional attacks on liberty that were the Alien and Sedition Acts, they secretly authored the Kentucky and Virginia Resolutions of 1798. Here are a few excerpts that really define exactly how things are supposed to work when two or more branches of the federal government conspire against the constitution and your liberty.

the several States composing the United States of America, are not united on the principle of unlimited submission to their General Government

whensoever the General Government assumes undelegated powers, its acts are unauthoritative, void, and of no force.

where powers are assumed [by the federal government] which have not been delegated [by the Constitution], a nullification of the act is the rightful remedy

So while it might be important to call, petition, demand, march, sue and vote bums out, because they’re all bums, there’s much more we’re supposed to do. When the federal government violates your rights, you’re not supposed to wait four years for new politicians in the hope that they’ll fix it. You’re not supposed to wait two, or four, or more years for some black-robed judge to pronounce that they’ve violated your rights. You are supposed to resist those violations of your liberty as they happen – and it is your state’s solemn duty to do the same.

NEW MOVEMENT

While such a task might seem daunting, it’s something that’s already happening today, and has been growing in recent years too.

In 2007, one state rep in Maine introduced a non-binding resolution opposing the REAL ID Act.

In 2008, one state rep in Oklahoma introduced a simple non-binding resolution reaffirming the Constitution as defined by the 10th amendment,.

In 2009, one state rep in Montana introduced a bill to nullify some federal gun laws and regulations.

In 2009, one state rep in Arizona introduced a state constitutional amendment to effectively ban a national health care plan in that state.

These simple, single acts by courageous people have grown into a state-level resistance to unconstitutional federal acts the likes this country has possibly never seen.

Here at the Tenth Amendment Center we have released model legislation for you to give to your state reps to demand that they stand with you and refuse to comply with unconstitutional acts from Washington D.C. Our latest? The Federal Health Care Nullification Act.

This Act is not over 1000 pages. It’s not 500 pages. It’s not a dozen, or even two. It’s one single page to nullify now.

Here’s a majority of what it says:

The Legislature of the State of _______________ declares that the federal law known as the “Patient Protection and Affordable Care Act,” signed by President Barack Obama on March 23, 2010, is not authorized by the Constitution of the United States and violates its true meaning and intent as given by the Founders and Ratifiers, and is hereby declared to be invalid in this state, shall not be recognized by this state, is specifically rejected by this state, and shall be considered null and void and of no effect in this state.

And it adds some much-needed ‘teeth’ too:

Any official, agent, or employee of the United States government or any employee of a corporation providing services to the United States government that enforces or attempts to enforce an act, order, law, statute, rule or regulation of the government of the United States in violation of this act shall be guilty of a felony and upon conviction must be punished by a fine not exceeding five thousand dollars ($5,000.00), or a term of imprisonment not exceeding five (5) years, or both.

They want to fine us or put us in jail for not buying insurance from some corporation. What’s next – fining us for not buying a Chevy? Well, it’s time that we turn this thing around – and in the federal health care nullification act – we fine THEM for violating our rights!

While this may seem difficult to accomplish – or even insurmountable – if we do nothing, or if we even do the same things we’ve been doing, we’re doomed to failure. But if we do what’s right, we will succeed! Samuel Adams put it best: “It does not require a majority to prevail, but rather an irate, tireless minority keen to set brush fires in people’s minds.”

Question: What do we do about it?

Here is an idea maybe we should Finnish ratifying the already proposed Corwin Amendment..

In 1861 in order to prevent the War between the States congress proposes the Corwin Amendment which says:

"No amendment shall be made to the Constitution which will authorize or give to Congress the power to abolish or interfere, within any State, with the domestic institutions thereof, including that of persons held to labor or service by the laws of said State."

While this amendment was clearly meant to prefer from congress the institution of slavery, the same institution no longer exist and is illegal in all states under state law. Furthermore even if it were to be made legal again in a state where would you get the slaves? The importation of slaves is already prohibited has been sense the early.

So this is not going to bring back slavery by any stretch of the imagination but it would knock out the 14th amendment and bring an end to other highly destructive federal intrusions(including health-care) forever and all we have to do is get 36 more States to ratify it. No need for a constitutional convention, or the unimaginable prospect of getting congress to propose a new amendment.

They already did that for us in dealing with the threat of secession back in 1861.

So far Ohio and Maryland have already clearly radiated it, so we need 36 others to follow suit.

I always thought that if before you went to vote do some homework and study the candidate. If they say they will do something for you then look a little deeper into there background because nothing is free, remember they are fighting for a job. The way Obama and most of the progressives got voted in was that there candy wrapper was better looking. Go out and do your homework. One last thing, we are the government and the people in Washington work for us we do not work for them.

Michael that is a beautiful essay and one I wish every American would read. And its all true. I believe at the very bottom of my being each and every principal that was stated here. They are all so obviously right, then what is the problem with America that we let this go on without an overwhelming response that literally rattles the doors of the White House and sends politicans running for cover? After many months of reading essay's and the input of people who feel exactly as you and I feel, I think I have found the problem that is preventing us from coming together in a group large enough to get the job done. Its the dates we have worked with. After a couple of beers its almost impossible to use quotes or the idea's behind quotes when you preface it with "In 1792" or "In 1798" or 1861,1865,1913 etc. with a straight face. As soon as you quote a date that old, people automatically shut out anything that follows. I am not saying we need to take our founders out of our founding. I don't really know what to do about it. Perhaps either you or one of the Constitutional Scholars who publish on this site as well as others could answer that question. I am completely serious here.

You're correct, that there is a general distrust of & ignorance in history.

There are a lot of causes, to be sure. We've lost faith in our fathers, faith in God to guide us. If they can be trusted, then history makes sense & we know to care about it.

The Founding Fathers were continuously referring to men in their past, to the progress made in the Reformation, in the Pilgrim & Puritan flight from religious & political persecution in England.

Because those generations, were the Founding Fathers, Founding Fathers.

I think history is the progress History is making, under God's will driving human development.

It is, after all, "His-Story".

A plan of our enemies is to make us forget our history. Didn't Karl Marx say that to get a people to accept communism, they needed to be stripped of the memory of their own history ?

Add to this the fact that the definitions of OLD & NEW have shifted. Consider:

Old used to mean 'trustworthy, proven, reliable, known quantity'.

Now we think of it 'old' as: worn out, out of style, not hip, etc. Quite the shift, eh ?

New used to be defined, as 'novel, not proven, questionable, untried.'

I think your salient observation about dates being old & therefore not gaining respect has to do a lot with this language & perception shift.

May I suggest that you take a look at a course on the Worldview of the Founding Fathers & the Declaration & the Constitution. It can be viewed online (if ya have DSL) or on DVD.

I've worked as a volunteer instructor on this course - it will give you way more respect & knowledge than 98 % of Americans on these matters, plus the intellectual ammo you crave. I know it will make the case, of why History isn't just 'nice to know', but necessary for us to prevail in these struggles for Liberty.

Also, in the Bible, read Psalm 78 for an amazing tale of how those Patriots of old who KNEW history & trusted God won the battles, and those who REFUSED to do so, lost them.

I dare say that if the 17th amendment had been repealed a while ago, this stupid bill would never have passed in the first place. We, the states, need a check on the House of Representatives and the executive office. No senator representing his/her state, not his party and special interests, would have voted for this bill.

Iwould like a document that must be signed by anyone running for state or federal office stating that they will refuse to vote for any issue that is unconditional. And if they do they will be subject to legal action.

To Barrie Konicov: Your post reminded me that voters need to demand that federal and state lawmakers do the following. Government leaders need to make comprehensive recall laws for lawmakers, executives and judges who start using their powers to serve the people differently from the way that they had promised to before they were elected / appointed.

This Obamacare is also a violation of the "forgotten amendment", the Ninth Article of the Bill of Rights. The right to seek medical care is a natural right retained by the people and the States should insure that this is not infringed upon by the agent created by the Constitution. Nullification is one answer to this problem. Another is to amend your State Constitution to define violation of Oath of Office as treason, and punishment in accordance of treason.

Well said 285sovereign. I grew up in a small town in East Texas and if a family's house burned the citizens would offer them shelter while we built them a new house. If someone needed medical care we would make sure his or her family was taken care of in there time of need. I'm 60 years old and have never had health insurance or life insurance. I only have car insurance because it is mandated by the State of Texas, but if I choose not to drive then I don't have to have car insurance.

Obviously you need to read more on liberty. Health care is NOT a right! It is a shame that you "needed(?) an operation to walk without pain", but it is not your right to take from me or anyone else to make your pain go away. Your pain does not give you the right to take other people's hard earned money. You must learn to live with pain, take meds, change your lifestyle or earn more money. While these options may not be possible that still does not give you a right to steal from others.

It used to be that religious, churches and other charity orgs would take up the gauntlet to help those in need, such as yourself. Not anymore. They are agents of the State (501's) and are beholden to their dictates, in order to be "tax free". Which they have no more right than you or I to have such "privilege". If they can be tax free, so should every American!

The Republicraps/Democraps are not the answer. It is you who must denounce every infraction of your rights. It is you who must become a Sovereign individual. It is you who must stop abusive legislation. When we end such usurpation's of power you will see the money that has been stolen returned to your pockets. THEN and only then will you be able to afford health care.

She probably has neighbors or churches that would enjoy helping her, but if that she looks to the state instead, then in effect, that State becomes the Neighbor or Church...personal relationships die & a Federal Statist cult is empowered.....

Sorry to disappoint seeming partisans like you, Kevin, but very few here who comment / blog at the TAC, care a whit about partisan wrangling.

If you haven't figured out that what ails us way transcends Partisanship, nothing we could say would help.

Bottom line, civil government keeps acting like God (ie: Idolatry) because unwise citizens (like you ?) keep treating it as such.

To us, to recognize such a false authority, as if it's legitimate, would make us guility of Idolatry.

Not going there. We're done with complying, in any way, shape or form with out of control government.

So called 'Congressional Leaders' (of either party) who act under the color of law to pass Unauthorized 'faux-law', are no more binding on us than a Chicago Mafia Don ordering us to buy his distilled kool aid, or an LA drug baron recruiting us to sell or buy his crack.

All their acts are Null & Void, of no effect, in every instance they exceed their authority or violate our Rights.

If that means we, along with our state reps, war in our state courts against the Fed, let's get to it.

If that means we move towards secession state by state, ready to go !

And God only knows where that might lead, but I refuse to live as a slave !

So, I respectfully suggest you chuck your faith in the Dems -any faith I had in the GOP was junked long ago, and put it in God & Grace & proper Lawful authority.

Civil government was established by our forefathers to guard our rights, and when it becomes destructive of those ends, we'll do away with it & form 'new guards for our freedoms', to quote the Declaration.

How that will happen, exactly, is not ours to know at this point.

But it is our duty to prepare ourselves & our children & grandchildren for those challenges, isn't it ?

Here in Georgia, we are trying to go the necessary further step with House Bill 877, which will have the state government exercise its rights under the 10th and do as was originally set up when the country was founded, ie, the state will be the central collector of all federally mandated taxpayer dollars, and will send off to Washington only the percentage of the tax dollars that are actually Constitutional. The rest will be returned to the citizens of the state of Georgia.
Expecting that what we had been doing that has not worked, will suddenly work if we just do it harder is 'more of the same".

We need to starve the beast.

Jefferson viewed interposition of the state on behalf of the citizens as allowable under the guidlines of the docuement that HE wrote.

Sharon, I'm sorry for your situation. I'm also sorry about kids starving in Africa and human rights violations in Asia. The key is, who is responsible for these problems (and their resolution)? I've got my own kids to raise and my own family to feed. I hope if something happens to me, my extended family will help them. In reality though... no one is responsible for my family except me and my family. If I die today, either God's grace takes care of them or they fend for themselves. The same goes for you and your pain. I hope someone helps, but the fact you EXPECT me to fix your problem is arrogant and quite frankly, very offensive.

Thank you for your post. I am highly encouraged by the numbers of people against this new healthcare law. The bill is unconstitutional is a nudge into socialism and /or marxism. The free market options and other healthcare reform propositions offered into legislation and ignored or shot down (many) I have seen do offer plans which would not bankrupt this country or states, hold the elective procedure of abortion unfunded, no insurance mandate with its "fine" is non compliant citizens ....naming a few things

It's not about "giving a damn about people like you". It's about retaining our liberties in the face of a tyrannical government. If you believe that the government should afford you health care expenses with money ceased
from other individuals then you are a socialist. It is as simple as that.
Your government has caused the problem of rising health care costs in the first place so you can thank them for that. It has imposed so many regulations and rules that have driven costs so high and it has all been by design.
The government doesn't care about you as you will see if this thing isn't reversed and the rationing starts kicking in. Nonetheless, there have been sob stories galore to make the lovers of liberty seem callous and evil by opposing this pipe dream that they are shoving down our throats.
Everyone has a threshold at which they will scream ENOUGH! Where do you draw the line? Will it be too late by the time they reach the line that you have drawn? Is it too late already?
So... you had this problem for 7 years. Did you do anything to try and fix the problem yourself? Did you speak with a surgeon or a bank loan officer to set up some type of payment plan? Nothing is free. Someone must pay the bill. Do you think that other people should be forced to pay your bills? I'm sorry that you had or have this problem but why should it be other people's responsibility to fix your problems? I know this seems unsympathetic to someone like you but the truth is that life is tough! If you want charity, be honest about it. Ask a church or put an ad in the paper begging for money. Americans are very charitable. I'm sure you would make out pretty well. But... to have the government rob others in your stead is despicable.

We have the best health care in the world, but there are definite problems. NO ONE wants to ignore them or do nothing. We just want solutions that won't detroy the good parts and that won't bankrupt us. Don't listen to the propaganda coming from the White House, democrats, and the MSM. You are operating on the false assupmtion that it's this bill or nothing. There are many things we could do that might be able to help someone like you. But this administration made the decision to only let one side come to the table and to go with every far left idea crammed into one bill without regard its cost or effect on either society or our economy. There are no cost controls.

Republicans were more than willing to work to find solutions to our problems, but were shut out. Meetings were held in secret locations, no invitations to the White House for months on end, and doors to health care meetings were literally locked. At the highly publicized televised bi-partisan meeting, Obama barely listened and seemed angry that his ideas were not accepted. Afterward, they said they would consider four or five Republican ideas. Last time I heard, all but one were struck from the bill that passed.

The States become a member of the Union of States by an agreement; The Enabling Act providing for the Admission of (state) on an equal footing with the original States. Along with the requirements of the new State, in order to join, there were expectations that government, State and federal, would abide by the the Mutual Assent of the Constitution and the Enabling Act.
You say, “...and it is your state's solemn duty to do the same.” That is not only true, but it is key to our efforts. People of the new States gave their assent based upon the requirements of the Enabling Act. The people today can withdraw that assent. There is no difference here than with any contract. Your State legislatures must understand that withdrawal of this assent is a valid option before it will stand up to its solemn duty.

When reading The Northwest Ordinance (Equal Footings Doctrine) you will find immediatley after the equal footing clause another clause that "and shall be at liberty to form a permanent constitutionand State government. Since Nevada and most Western States were required to place a disclaimer clause in their Constitutions or not become a State there was a violation of federal law and many of the citizens were left with a beaucratic government rather than a republican form of government. Shall be at liberty is a powerful statement. We have too many politicals with personal ambition and this gets in the way of self government.

I think Michael Boldin needs a better understanding of the core documents of the United States. He says we have our rights as a birthright. I am not saying I disagree, but I find what he DID NOT SAY to be even startling.

Mr Boldin: why don't you just quote the Declaration of Independence? "We hold these truths to be self-evident that all men are CREATED with certain unalienable rights..."

Great point, Tony, I appreciate your pointing this out. Keep in mind, just because Michael may not have cited this position, doesn't mean he doesn't appreciate or hold to it.

I mean, let's keep things civil - our energies need to be focused in the battle, not battling each other.

That said, I do think that we find the Declaration of Independence more illustrative of Principles of Liberty, and the Constitution is more procedural, assuming the Principles stated in the Declaration.

Thus, to read the Constitution, without comprehending the Principles of Liberty & our Creator & our Rights coming from Him, is to eventually, Mis-read the Constitution.

I've read quite a bit here at the TAC, and I think Michael does honor those Principles.

Excellent commentary by Michael. I encourage Arizona to join states calling for nullification of the obscene Patient Protection and Affordable Care Act (aka Obamacare) as blatantly unconstitutional under the tenth amendment (and other parts of the Constitution as well).

I like the proposed FEDERAL HEALTH CARE NULLIFICATION ACT. C'mon, state legislatures! Show some backbone!

Thanks, Paul - appreciate the feedback! We the people have been doing a lot of lobbying of politicians over the last year, and it hasn't worked too well in my opinion. We believe, in partnership with WeRefuse.com, that if all that passionate energy were focused on the state politicians, we could actually stop this mess....and move on to other unconstitutional federal "laws" that need to be addressed. I for one have been reading as much as I can find on the subject of Nullification. I do believe that if and when this action takes hold, we will begin to see some positive changes take place. I have E-mailed, and written to my Reps and Congress people to let them know my thoughts on many issues. The time has come for all Liberty Loving Americans to stand and fight for what "WE THE PEOPLE" believe in. Truth, Justice, Limited Government! There is no better time than now to let our OUT OF CONTROL govt. know, We aren't going to accept anything we feel is against our Constitution! I don't like the feeling of, (I Wonder What They're Going to do Today?) They just keep feeding us more ammo to move in the direction of (OH HELL NO!!!) If they're not going to listen to WE THE PEOPLE, then we are not going to take their crap. It is our right to ignore any and all UNCONSTITUTIONAL and UNJUSTIFIABLE actions they want to take. I don't know about you, but, I WANT MY COUNTRY BACK!!!! We all need to start undoing the damage this administration has already caused! Our future generations deserve that much. FAITH, HOPE, and CHARITY! That leaves no room for socialism! Trust in GOD and help each other. We don't need no stinking "BIG GOVERNMENT!!!! They work for us!!! Let's all let them know that's how it is!!! Semper Fi!!!
