For the past few days, I’ve received loads of emails urging me to get active regarding the healthcare vote – most of which had a subject line similar to: “Last Chance to Stop National Healthcare!”
Well, if you believe the only way to protect your rights is by begging federal politicians to do what you want, then these emails are certainly right. The vote went as expected, and so will the next.
So if you think marching on D.C. or calling your Representatives, or threating to “throw the bums out” in 2010 or 2012 or 20-whatever, is going to further the cause of the Constitution and your liberty – you might as well get your shackles on now. Your last chance has come and gone.
But, those of you who visit this site regularly already know that the Senate’s health care vote is far from the end of things – and you also know that even when it goes into effect (which I assume some version will), it’s still not the end of the road for your freedom.
The real way to resist DC is not by begging politicians and judges in Washington to allow us to exercise our rights…it’s to exercise our rights whether they want to give us “permission†to or not.
Nullification – state-level resistance to unconstitutional federal laws – is the way forward.
When a state ‘nullifies’ a federal law, it is proclaiming that the law in question is void and inoperative, or ‘non-effective,’ within the boundaries of that state; or, in other words, not a law as far as that state is concerned.
It’s peaceful, effective, and has a long history in the American tradition. It’s been invoked in support of free speech, in opposition to war and fugitive slave laws, and more. Read more on this history here.
Regarding nullification and health care, there’s already a growing movement right now. Led by Arizona, voters in a number of states may get a chance to approve State Constitutional Amendments in 2010 that would effectively ban national health care in their states. Our sources here at the Tenth Amendment Center indicate to us that we should expect to see 20-25 states consider such legislation in 2010.
20 States resisting DC can do what calling, marching, yelling, faxing, and emailing has almost never done. Stop the feds dead in their tracks.
For example, 13 states are already defying federal marijuana prohibition, and the federal government is having such a hard time dealing with it that the Obama administration recently announced that they would no longer prioritize enforcement in states that have medical marijuana laws.
Better yet, in the last 2+ years more than 20 states have been able to effectively prevent the Real ID Act of 2005 from being implemented. How did they do that? They passed laws and resolutions refusing to comply with it. And today, it’s effectively null and void without ever being repealed by Congress or challenged in court.
While the Obama administration would like to revive it under a different name, the reality is still there – with massive state-level resistance, the federal government can be pushed back inside its constitutional box. Issue by issue, law by law, the best way to change the federal government is by resisting it on a state level.
That’s nullification at work.
Over the years, wise men and women warned us that the Constitution would never enforce itself. The time is long overdue for people to start recognizing this fact, and bring that enforcement closer to home.
The bottom line? If you want to make real change; if you want to really do something for liberty and for the Constitution…focus on local activism and your state governments.

Under such any member of congress in the house or senate should be held accountable for taking payoff to vote for the healthcare bill.

(2) directly or indirectly, gives, offers, or promises anything of value to any person, for or because of the testimony under oath or affirmation given or to be given by such person as a witness upon a trial, hearing, or other proceeding, before any court, any committee of either House or both Houses of Congress, or any agency, commission, or officer authorized by the laws of the United States to hear evidence or take testimony, or for or because of such person’s absence therefrom;
(3) directly or indirectly, demands, seeks, receives, accepts, or agrees to receive or accept anything of value personally for or because of the testimony under oath or affirmation given or to be given by such person as a witness upon any such trial, hearing, or other proceeding, or for or because of such person’s absence therefrom;
shall be fined under this title or imprisoned for not more than two years, or both.
Also those that are proposing the offers should also he healed accountable.
Dear Judy Burges. I just wanted to tell you that I saw an article in our local paper about the measure that you are trying to get through about President Obama having to prove his citizenship and just wanted to say MAY GOD BLESS YOU. I totally agree with your effort and cannot understand why this hasn't been started before now. Keep up the good work. I forgot to mention that I live in California and not Arizona.
I just want to say that this is really extreme liberal thinking. If the entire American population keeps becoming this divded, the states will soon divide and America will fall. However, united we stand. This nullification reminds me of the time when States had nullified the right for blacks to go into the same school as whites. Give Obama a chance to show us what he can do. We voted him for president for change, and now we are too scared to accept it. Like he said, change is hard, but we as a nation need to move foward. It is no longer the government's fault, they are trying as hard as they can, but we need to give them a chance to work instead of going against them at every turn.
But on Health Care I don't know why it has to be so darn expensive, and like why can't old timers buy medicine from Canada... and well, why the heck can't we help our own citizens out for a change? I don't think a REASONABLE plan for the whole country should be too much to ask. It works for our Congress, ok. And they don't have to take the 100% paid for by the taxpayer plan - they can opt to stay on the wife's private plan if they like.
This whole hullabaloo about "socialism", I don't buy it. HealthCare execs, Insurance Companies and Big Pharma spent millions to crush this, both in the media and these so-called "astro-turf groups" (fake grassroots groups).
Of course the people that Ben Bernake reports to - want to make as much money as THEY can (on wars, robbing the Treasury, stock losses - what have you) before THEY -- FINALLY CRASH THE US DOLLAR (and our economy - fer good) AND REPLACE IT WITH THE "AMERO" ( a combined currency of USA, Canada & Mexico). This co-incides with THEIR plans for a NORTH AMERICA UNION (GOOGLE IT) combining our three (3) countries. [Started with Clinton & NAFTA, continued by "W" Bush (see: SPP Treaty: Security, Partnership & Prosperity agreement - effectively ERASING our borders North & South); and SURELY TO BE CONTINUED BY OBAMA (he's All ready and one (1) summit with both leaders of Canada & Mexico). ie. THEY WANT TO MAKE USA GO BROKE (for whatever EVIL purposes, bring on more Tyranny, etc); but conversely then - THEY make sure that social programs can't or won't exist by default. Billionaires LOVE this stuff - GOOGLE "The L - curve".
Anyway, I agree with this 10th Ammendment stuff (one of our last defenses) especially on the other issues on this blog like US Soveriegnty (touched upon above - NAU), and not more gun control based on a "Police State" model, etc.
And B) USA has the BEST Gov't Run HEALTHCARE in the ENTIRE WORLD! (aside from the fact that people like Medicare; which BTW they could have simply extended to older and younger people). THINK - where does every President and MOST of Congress go (including REPLICONS & Demorats) TO GET OPERATED ON? Bethesda Naval Hospital! The one of the BEST healthcare facility's around TOTALLY GOV'T RUN. In fact, U.S. Senator Mitch McConnell (Republicon) swearing a "NO" vote all along - just came back from surgery a few weeks ago at... you guessed it - Bethesda - PAID FOR BY YOU & ME THE TAXPAYERS! Come to think of it - why can't we ALL have the same Health Plan that Congress GETS?!
So A) They said this Reform bill would cost $800 billion over 10 years. Say that's true, for a moment - why so much noise about the cost when wars that we are currently in (and now THEY want more war! - see LIEberman calling for a pre-emtive strike on Yemen) cost Trillions and Trillions. On top of that, the criminal bailout of Wall Street has reached 4-6 Trillion; PLUS Obama's pledge to cover up to $23 Trillion in THEIR bad BETS! So a measly (I know, but still) - A measly $800 billion spread over 10 years is too much for something (if done right) is to HELP "The People"?!
I guess it's all about what do you want to spend our tax dollars on? Oil wars and fat cat greedy bankers?
I haven't read a lot about the final HealthCare bill but, I gather there's very little "reform" (as in watered down/lack of enforcement of any new rules) - and basically it's a huge giveaway to big insurance and big pharma; (the Lobbyists got their way). Essentially does nothing, actually it make healthcare worse & does nothing to slow the rising costs. And because it's a FAILURE from the start - it's will make any MEANINGFUL Reform later on that much more difficult to accomplish.
Having said all that - I for one would have liked to see a public option (not real expensive - that I could pay into; and not have to worry about pre-existing conditions); because I will be losing my healthcare plan I'm on now through no fault of my own.
I have communicated with my Washington State Legislators, calling their attention to the bill that passed both houses of the Arizona State Legislature that would Nullify Obamacare, urging them to copy it and introduce the same legislation here. I have an email distribution list of thousands of people nationwide and have urged them to do the same thing. We proved in 2005 that we CAN block Federal legislation, even when the President signs it into law when 20 States passed bills refusing to implement the REAL ID ACT. It went NOWHERE. Similarly, we HAVE THE TOOLS WE NEED to block "OBAMACARE" from going anywhere too! In FACT, we HAVE TO BLOCK IT. FAILURE is NOT an option! If we fail, Obamacare will trigger a Tsunami of illegal aliens that will break our BACKS economically. Moreover, huge numbers of MDs will QUIT because they honor their Hippocratic oaths and will refuse this Fedstapo red tape and dictatorial heavy handedness. That will create even BIGGER Dr.shortages and long lines than the flood of illegals into the system will. This poses a threat to our LIVES and we MUST stop it! NO MORE HAND WRINGING- WE KNOW WHAT TO DO!!!

RE: Health Care Nullification. This article is great!! I know there are things we ordinary citizens can do to get the process going in our states. I live in California and don't know if our rino Governor has any intention of fighting this health care debacle on a state level, as he is married to a Kennedy; some of the greatest socialists of our time. I am ready for a revolution to take our country back from the Communists in the white house!!

You have it right concerning the strategy, we just need to implement the following suggested tactics;
1. Inform the state citizens about the nullification process.
2. Encourage them to put the pressure on the Governor and Legislators to enact meaningful nullification laws.
3. Encourage them to replace the politicians who will not comply with their wishes.
4. Inform them that the biggest hurdle to overcome is the noose of federal funding, and that they have to show the politicians how to deal with it.
5. Have them follow the nullification legislative process from introduction, to committee, to final vote, and keep the pressure on.
These are just a few general strategies, and know it will require a lot of planning and effort.

If the states exhaust all their legal remedies and we need to fall back on nullification, will it work and has it ever worked or is it a theory. I am afraid this might be where it is heading.
William, there's links in this article above discussing efforts to nullify laws - NOW. Real ID and Federal Marijuana laws are the most recent examples. In the much more distant past, there were fugitive slave laws, tariffs, the nationalization of the militia and more...
What law allows congress to create health care? This is a fine test for the tenth amendment.
It would be great if each state came up with their own heath care legislation.
The national media could scrutinize and the public could learn about each one. We would see implemented 50 different plans. Time and experience would scrutinize all of them. We would learn from experience.
The reason why this natural ingenuity isn’t happening is two-fold. Both the federal government and the incorporation of towns by state constitutions with local officials have weakened the state government; and the federal government is devised to discourage bad impetus by states, as opposed to encouraging good impetus. This is so if you derive the nature of federal authority as initially incepted to, 1) keep the states from warring each other over disputed (Indian) territory, 2) Provide a large navy, and conscript a general army to protect us effectively from France, Spain, England and Indians and 3) Eliminate the duties and tariff states might impose on each other that would hinder trade.
It is this thinking, that reduces the care a state could naturally give itself, and that reduces economic competition, which makes the government and media less able to see the states as natural care-takers of their needs.
Some states might develop health care programs that attract rich people to move there; others, health care programs that attract poor people to move there; we don’t know, we would have to see it play out. But the point is to encourage states to develop their own character, characteristics and identity, because the further that is honed and worked out, the better a state can take care of itself--because it has identify it can focus on, and character that can be applied
Having different health care reform legislation in each state, not only allows the more direct input of the people, but is a wonderful genus of competition, increasing the seriousness of our states and nation. Having a different program for each state will make time a experience be the judge, and let us view a wide sample of results to apply.
Examined with the eventual data of this opportunity, the course will be sown whereby the guidelines of wisdom and the nature of people and states are more seen; solutions come from within, not without. Today, when a state complains about its problems, (overdevelopment, high taxes, corruption) they do not turn to other states for help with a solution. Likewise, when a state does something right, other states don't learn from it. Mandating different solutions from different states, will teach the states to look to each other for guidance and help.
She sure has, T. And, she's a signer of our 10-4 Pledge!

How many of you (us) are aware of the 2d paragraph of Article IV of the US Constitution? Here's a little reminder:
The Constitution of the United States as we know it. is not really a document that established a true federal government. To observe my reasoning, I invite you to read carefully the second paragraph of Article. IV as quoted following:
"This Constitution, and the Laws of the United States which shall be made in Pursuance thereof, and all Treaties made, or which shall be made, under the Authority of the United States, shall be the supreme Law of the Land; and the Judges in every State shall be bound thereby, any Thing in the Constitution or Laws of any State to the Contrary notwithstanding."
This "Federal Preemption" is the subject of an entire volume of the same name [Federal Preemption: States' Powers, National Interests, Editors Richard A Epstein and Michael S Greve, The AEI Press (Publishers for the American Enterprise Institute) Washington DC, 2007]
I am thankful for the multitudes that have been involved in the "Tea Parties". I am thankful for the People who have come alive that were hitherto disinterested because of complacency, now, they see our Beloved Country is on the "chopping block" and they have said what can we DO.

Two Words must be in the Vocabulary of American Legislators at all levels:
1. REVERSE - 1963 Supreme Court ruling given to the Atheist O'Hare to remove Prayer and Bible reading from the Public Schools. Public School authority belongs at the LOCAL level not State or Federal. LOCAL SCHOOL DISTRICTS funded by LOCAL taxpayers NOT STATE or FEDERAL GRANTS. The LOCAL folks will once again come under the "Fear of God" which built this Beloved Nation. The Ten Commandments in the Public Schools will bring back the "Fear of God" - God sees what you do in the dark and you will give an account to Him.
2. REPEAL - All laws contrary to the CONSTITUTIONS, whether it is State or Federal, SHALL be REPEALED. Our Liberty must be in our FOUNDATIONAL law given to us by God-fearing men who LOVED their people.
This new VOCABULARY will give us back our Beloved Country.

This is clearly to protect religion from government, and not government from religion. Because religion is good, helping to explain what is hard to understand, and government is morally ambiguos.
The free excercise of religion certainly can include prayers in school, provided they are not mandatory, or ordered.
The Supreme Court should be ashamed of itself for messing up this simple law; judicial reform should spring from some of these clear errors by the court. Judicial reform can consist of more judges hearing a case: (1,3 7, or 9, judges are far too inhibited by the status quo. The more judges judging together, I believe, the more accurate a ruling) (Judges get burned out quick and go on automatic; shorten their terms) (There is nothing incredible about judging, most people are capable of hearing a case, making a judgement; open up the profession to the less exalted and more humble; stop exalting judges as incredible people capable of making a decision and exerting law---many people can do this, and should, together, for short terms, like jurists.

Yes I agree, while fighting on the National front, let us also remember to win the battles on the Local and State fronts as well. If we take back our States, nothing the Feds say or do can stop us.
I encourage everyone to know who represents you on the State and local Levels as well as the National. Find out what they stand for, look and see who is on the School board, and what they believe. Make every vote count on every level and a wise one. We need to take back every square inch of our governments on every level, and that requires informing yourselves on who you think the best man or woman for the jobs are.
I wrote to my reps in the NJ General Assembly (one of whom is a co-sponsor of a state sovereignty resolution here) and State Senator tonight. I'm praying it makes a difference, and to the extent possible, I'll be encouraging others in my state and others to do so.

I agree with your thoughts on 'State Nullification' however-some States are totally diferent than others. There 's Dark Blue Lib States and there are Dark Red States with different mindsets. I live in CT, well run Tea Party movement but it would be hard to get enough People on board with 'Nullification'. Unless the big 'O' crosses the line, and there is a line that if crossed there will be great friction!! Otherwise I will learn and do what I can, maybe in time move to a 'Nullification' State. But I see civil unrest anyway because people are too Pissed!!!!

Moneylending (whether "real" or "fiat" (fantasy - conjured)) at usury is at the root of the problem. The borrower is slave to the lender. The US Constitution grants power to congress to BORROW money. When the US government does so, it makes us all slaves of the moneylenders.
OldDog has identified the real players in this circus. We vote with our dollars. I try to buy everything from my local community, and pulled my money from the banksters (BofA, Chase, etc.) My money is with small, family held banks, or at worst, small regional banks, who are getting equally hammered by the big boys. The consolidation of wealth in 2008, 2009, and 2010 will make the the Great Depression's consolidations look like chicken feed. Supporting community enterprises will have to go hand in hand with our overall resistance to a political system that is owned by the biggest international interests. Nullification efforts are worthwhile, politically. Community focus is necessary, economically. AIG identifying usuary as a root problem is right on target, too.

I don't know what is the best way to nullify these bills but has anyone looked into what some districts did in Texas to nullify social security. I've heard some districts opted out and are on their own social security plan that is better. I'm not sure what the details are but perhaps that can point us in the right direction.
I'll get to that 10-4 pledge as soon as I can read it. Anything to do with States rights and Nullification is OK by me. In fact 1861 was the last time the People of the United States locked horns over this issue. The people then who had real guts happend to be demonized and a lot of them died over the principle of a weak federal government. They had Lincoln now we have Obama. Who will trash the Constitution worse and who will be the bigger tyrant?

I have to agree that we missed our boat but the way our system is set up another boat can come along and sink the first one if enough people get on the second boat.
I advocate electing people to office who have no prior experience. I myself have decided to run but people like the comfort of a well worn pair of shoes. Professional politicians are only as good as it takes them to be replaced by someone else or run the time of a term limit. Attorneys should be banned completely from holding office because by their very nature they just can't help taking advantage of a legal situation they have control over. They use their law degree to take us to the cleaners. Ever wonder why simple laws are so complicated? Smoke and mirrors. They throw all that legal jargon in there to confuse the people. Vote yes on No kind of stuff.
I will believe America has a chance when people step up and support common ordinary people like me who are willing to stake their lives in order to ensure the Republic endures instead of quasi celebrities and talking heads with empty suits.

As long as there is obligation to 'The System' at whatever level, thou shalt comply.
Only by stepping outside 'The System' can these goals be accomplished.
In legality, either an individual extricates themselves or the 'State' secedes.
Acceptance gives the right of control, like it or not. That means any acceptance from the fed, etc.
This could/can be done only by a full divorcement between the two parties involved.
IF anyone were to hold the officers of our government to account for their actions, then forward progress could be made and very quickly.

As I have advocated, 'We The People' need a lot less talk and a lot more action!!!

And what might your suggestion be, Larry? A lot of people reading this who write to their legislators ARE also out there at the protests, helping with campaigns for candidates to kick the bums out at the federal, state and local levels, trying to wake up their friends and family to get them out to vote, etc. What would qualify as ACTION in your book, Larry? Does helping with campaigns, being in voter drives, being at the protests, educating people at the local level or even going so far as to run for office count? Or is even that too light for you?
This isn't Italy, where their leader got beaned in the head by someone who didn't like his policies. We're Americans. We're better than that. We still have a chance to get stuff done through non-violent means. At least TRY some of what Mr. Boldin suggests, and what others suggest, or come up with your own ideas. But don't just take it lying down.
And for the record, Reagan talked to Gorbachev and Brezhnev before him. He was the first President to really tell them "NO" on anything significant. He stood up to the statists overseas. It's time for us to do the same against the statists here.
