For the past few days, I’ve received loads of emails urging me to get active regarding the healthcare vote – most of which had a subject line similar to: “Last Chance to Stop National Healthcare!”
Well, if you believe the only way to protect your rights is by begging federal politicians to do what you want, then these emails are certainly right. The vote went as expected, and so will the next.
So if you think marching on D.C. or calling your Representatives, or threating to “throw the bums out” in 2010 or 2012 or 20-whatever, is going to further the cause of the Constitution and your liberty – you might as well get your shackles on now. Your last chance has come and gone.
But, those of you who visit this site regularly already know that the Senate’s health care vote is far from the end of things – and you also know that even when it goes into effect (which I assume some version will), it’s still not the end of the road for your freedom.
The real way to resist DC is not by begging politicians and judges in Washington to allow us to exercise our rights…it’s to exercise our rights whether they want to give us “permission†to or not.
Nullification – state-level resistance to unconstitutional federal laws – is the way forward.
When a state ‘nullifies’ a federal law, it is proclaiming that the law in question is void and inoperative, or ‘non-effective,’ within the boundaries of that state; or, in other words, not a law as far as that state is concerned.
It’s peaceful, effective, and has a long history in the American tradition. It’s been invoked in support of free speech, in opposition to war and fugitive slave laws, and more. Read more on this history here.
Regarding nullification and health care, there’s already a growing movement right now. Led by Arizona, voters in a number of states may get a chance to approve State Constitutional Amendments in 2010 that would effectively ban national health care in their states. Our sources here at the Tenth Amendment Center indicate to us that we should expect to see 20-25 states consider such legislation in 2010.
20 States resisting DC can do what calling, marching, yelling, faxing, and emailing has almost never done. Stop the feds dead in their tracks.
For example, 13 states are already defying federal marijuana prohibition, and the federal government is having such a hard time dealing with it that the Obama administration recently announced that they would no longer prioritize enforcement in states that have medical marijuana laws.
Better yet, in the last 2+ years more than 20 states have been able to effectively prevent the Real ID Act of 2005 from being implemented. How did they do that? They passed laws and resolutions refusing to comply with it. And today, it’s effectively null and void without ever being repealed by Congress or challenged in court.
While the Obama administration would like to revive it under a different name, the reality is still there – with massive state-level resistance, the federal government can be pushed back inside its constitutional box. Issue by issue, law by law, the best way to change the federal government is by resisting it on a state level.
That’s nullification at work.
Over the years, wise men and women warned us that the Constitution would never enforce itself. The time is long overdue for people to start recognizing this fact, and bring that enforcement closer to home.
The bottom line? If you want to make real change; if you want to really do something for liberty and for the Constitution…focus on local activism and your state governments.

Under such any member of congress in the house or senate should be held accountable for taking payoff to vote for the healthcare bill.
(c) Whoever—
(1) otherwise than as provided by law for the proper discharge of official duty—
(2) directly or indirectly, gives, offers, or promises anything of value to any person, for or because of the testimony under oath or affirmation given or to be given by such person as a witness upon a trial, hearing, or other proceeding, before any court, any committee of either House or both Houses of Congress, or any agency, commission, or officer authorized by the laws of the United States to hear evidence or take testimony, or for or because of such person’s absence therefrom;
(3) directly or indirectly, demands, seeks, receives, accepts, or agrees to receive or accept anything of value personally for or because of the testimony under oath or affirmation given or to be given by such person as a witness upon any such trial, hearing, or other proceeding, or for or because of such person’s absence therefrom;
shall be fined under this title or imprisoned for not more than two years, or both.
Also those that are proposing the offers should also he healed accountable.

You have it right concerning the strategy, we just need to implement the following suggested tactics;
1. Inform the state citizens about the nullification process.
2. Encourage them to put the pressure on the Governor and Legislators to enact meaningful nullification laws.
3. Encourage them to replace the politicians who will not comply with their wishes.
4. Inform them that the biggest hurdle to overcome is the noose of federal funding, and that they have to show the politicians how to deal with it.
5. Have them follow the nullification legislative process from introduction, to committee, to final vote, and keep the pressure on.
These are just a few general strategies, and know it will require a lot of planning and effort.
RE: Health Care Nullification. This article is great!! I know there are things we ordinary citizens can do to get the process going in our states. I live in California and don't know if our rino Governor has any intention of fighting this health care debacle on a state level, as he is married to a Kennedy; some of the greatest socialists of our time. I am ready for a revolution to take our country back from the Communists in the white house!!

I have communicated with my Washington State Legislators, calling their attention to the bill that passed both houses of the Arizona State Legislature that would Nullify Obamacare, urging them to copy it and introduce the same legislation here. I have an email distribution list of thousands of people nationwide and have urged them to do the same thing. We proved in 2005 that we CAN block Federal legislation, even when the President signs it into law when 20 States passed bills refusing to implement the REAL ID ACT. It went NOWHERE. Similarly, we HAVE THE TOOLS WE NEED to block "OBAMACARE" from going anywhere too! In FACT, we HAVE TO BLOCK IT. FAILURE is NOT an option! If we fail, Obamacare will trigger a Tsunami of illegal aliens that will break our BACKS economically. Moreover, huge numbers of MDs will QUIT because they honor their Hippocratic oaths and will refuse this Fedstapo red tape and dictatorial heavy handedness. That will create even BIGGER Dr.shortages and long lines than the flood of illegals into the system will. This poses a threat to our LIVES and we MUST stop it! NO MORE HAND WRINGING- WE KNOW WHAT TO DO!!!

I haven't read a lot about the final HealthCare bill but, I gather there's very little "reform" (as in watered down/lack of enforcement of any new rules) – and basically it's a huge giveaway to big insurance and big pharma; (the Lobbyists got their way). Essentially does nothing, actually it make healthcare worse & does nothing to slow the rising costs. And because it's a FAILURE from the start – it's will make any MEANINGFUL Reform later on that much more difficult to accomplish.
Having said all that – I for one would have liked to see a public option (not real expensive – that I could pay into; and not have to worry about pre-existing conditions); because I will be losing my healthcare plan I'm on now through no fault of my own.
So A) They said this Reform bill would cost $800 billion over 10 years. Say that's true, for a moment – why so much noise about the cost when wars that we are currently in (and now THEY want more war! – see LIEberman calling for a pre-emtive strike on Yemen) cost Trillions and Trillions. On top of that, the criminal bailout of Wall Street has reached 4-6 Trillion; PLUS Obama's pledge to cover up to $23 Trillion in THEIR bad BETS! So a measly (I know, but still) – A measly $800 billion spread over 10 years is too much for something (if done right) is to HELP "The People"?!
I guess it's all about what do you want to spend our tax dollars on? Oil wars and fat cat greedy bankers?
And B) USA has the BEST Gov't Run HEALTHCARE in the ENTIRE WORLD! (aside from the fact that people like Medicare; which BTW they could have simply extended to older and younger people). THINK – where does every President and MOST of Congress go (including REPLICONS & Demorats) TO GET OPERATED ON? Bethesda Naval Hospital! The one of the BEST healthcare facility's around TOTALLY GOV'T RUN. In fact, U.S. Senator Mitch McConnell (Republicon) swearing a "NO" vote all along – just came back from surgery a few weeks ago at… you guessed it – Bethesda – PAID FOR BY YOU & ME THE TAXPAYERS! Come to think of it – why can't we ALL have the same Health Plan that Congress GETS?!
Of course the people that Ben Bernake reports to – want to make as much money as THEY can (on wars, robbing the Treasury, stock losses – what have you) before THEY — FINALLY CRASH THE US DOLLAR (and our economy – fer good) AND REPLACE IT WITH THE "AMERO" ( a combined currency of USA, Canada & Mexico). This co-incides with THEIR plans for a NORTH AMERICA UNION (GOOGLE IT) combining our three (3) countries. [Started with Clinton & NAFTA, continued by "W" Bush (see: SPP Treaty: Security, Partnership & Prosperity agreement – effectively ERASING our borders North & South); and SURELY TO BE CONTINUED BY OBAMA (he's All ready and one (1) summit with both leaders of Canada & Mexico). ie. THEY WANT TO MAKE USA GO BROKE (for whatever EVIL purposes, bring on more Tyranny, etc); but conversely then – THEY make sure that social programs can't or won't exist by default. Billionaires LOVE this stuff – GOOGLE "The L – curve".
Anyway, I agree with this 10th Ammendment stuff (one of our last defenses) especially on the other issues on this blog like US Soveriegnty (touched upon above – NAU), and not more gun control based on a "Police State" model, etc.

But on Health Care I don't know why it has to be so darn expensive, and like why can't old timers buy medicine from Canada… and well, why the heck can't we help our own citizens out for a change? I don't think a REASONABLE plan for the whole country should be too much to ask. It works for our Congress, ok. And they don't have to take the 100% paid for by the taxpayer plan – they can opt to stay on the wife's private plan if they like.
This whole hullabaloo about "socialism", I don't buy it. HealthCare execs, Insurance Companies and Big Pharma spent millions to crush this, both in the media and these so-called "astro-turf groups" (fake grassroots groups).

I just want to say that this is really extreme liberal thinking. If the entire American population keeps becoming this divded, the states will soon divide and America will fall. However, united we stand. This nullification reminds me of the time when States had nullified the right for blacks to go into the same school as whites. Give Obama a chance to show us what he can do. We voted him for president for change, and now we are too scared to accept it. Like he said, change is hard, but we as a nation need to move foward. It is no longer the government's fault, they are trying as hard as they can, but we need to give them a chance to work instead of going against them at every turn.
