Arkansas: State Sovereignty Bill Filed

HCR1011, a resolution affirming the sovereignty of the state of Arkansas under the 10th Amendment to the U.S. Constitution was filed this afternoon by Rep. Debra Hobbs (R-Rogers). The resolution goes on to say that this is to serve as “Notice and Demand to the federal government, as our agent, to cease and desist, effective immediately, mandates that are beyond the scope of these constitutionally delegated powers.”

The resolution is part of a grassroots movement in state legislatures across the country as a protest to the intrusion of the federal government into state government affairs. Oklahoma recently became the first state in this movement to pass this type of resolution, HJR1003. As many as twenty other states are reportedly considering similar resolutions to Oklahoma and actual resolutions have been introduced in Arizona, Hawaii, Montana, Michigan, Missouri, New Hampshire, and Washington.

I spoke with Rep. Jon Woods, who is co-sponsoring the bill along with Rep. Debra Hobbs and Rep. Roy Ragland. Rep. Woods helped explain to me why they felt this needed to be filed. Rep. Woods said that they “have been working on this legislation since June, due to the growing trend with the Federal Government that all the answers should come within Washington, D.C., whether it’s No Child Left Behind or the Fairness Doctrine.”

He said that the final straw was the announcement today from the chairman of the U.S. Senate Banking Committee Chris Dodd who they may have to nationalize our banking system. Rep. Woods said, “The Federal Government is the agent to the state, we are not an agent to the Federal Government. This resolution affirm that.”

This is the right path. Standing up for the Constitution is in the best interest of all citizens. I think this,passed in the majority of states, would send a REAL message to D.C.

I recently emailed Representative Vic Snyder ref: the 2nd amendment and got the following reply. Also emailed Sens Pryor and Lincoln, Pryor replied with essentially the same answer as Snyder. Heard nothing from Lincoln as usual, however she will hear from me next November.

Now we’re talking. The 10th Amendment probably should have been the first. Too often taken for granted. I agree, that this bill should be beefed up to reinforce the validity of the others, especially the First, Second and Fourth.

I would like to thank each of the twenty states for taking the lead to get the federal government back within the guidlines of the constitution. I have little resources, little pull in government but I have faith in my Father in Heaven that he will work through normal people like yourself to bring this great nation back to where God would have us. I have enjoyed your website, I read it each day and forward it to friends and foe. I have but one question at this time. Where are the backbones of our leaders in North Carolina? I just remembered, there standing in line with their hand held out!

if the second amendment grants the right to keep and bear arms, then a reaffirmation of the 10th amendment would in effect put the right to keep and bear arms at the forefront.

Issac, you're right about that. Since there's no authority anywhere in the Constitution for the federal government to restrict gun rights, then reaffirming the 10th also reaffirms the 2nd - and in fact, the rest of the bill of rights.

James, not sure why the Arkansas resolution isn't mentioning Guns or gun rights. Montana and Michigan, for example, put this in the forefront.

But, we must remember, that virtually everything that the federal government does these days is in violation of the Constitution, and every step to regain the proper balance under the 10th Amendment, is a positive step towards liberty.
