Is there any information abot the Act ERISA passed by Congress in 1974 and how the 10th amendment may apply to that Act? This law allows large insurance companies to go after monies received in lawsuits. This money is to be used for future medical treatment. These companies are allowed to place a lien on money awarded to the victim. They claim that at the time you sign up for health insurance as a benefit offered by your employer you give them the Right of Reimbursement for medical bills they paid for due to injuries you sustained at the fault or neglience of another party. You, however are not entitled for Right of Reimbursement for paying monthly premiums not used.
